divorce & change of address etc.

Hello VJ'ers :)

It has been a while.

I just have a couple questions.

My husband and I have been seperated for over a year now. I have filed for divorce with him (uncontested). I gave him the papers june of 2011 to complete and turn in but him being the procrastinator, he has yet to turn it in. He says he will turn it in April.

I have moved across the country and have been living in a different state for over a year now and in a happy relationship. We are planning to visit Canada next week. Its only a 2 hour drive from where we live so we are going there by car.

It has never crossed my mind, but I was wondering if there would be any issues when i am RE-entering the US.

a. I never knew this but just found out from reading the forums here that I am supposed to report a change of address because i moved. My address on file with the USCIS is still my husband's address where he still currently resides. So if thats the case, should i report my change of address now before we head over to canada?

b. Was I supposed to report my seperation/pending divorce to USCIS? are you supposed to report a divorce at all?

c. My bf and I had a child together recently and we are taking her with us. we are only required to show her birth certificate and no need of passport. When we are re-entering the US and the officer sees that I am with my BF, and my daughters birth certificate states my BF and I as her parents, but on my file (because they scan passports even if re-entering via car) and see that the person i'm with is my bf not my husband, will i have a problem?

p.s) I was with my husband for 8 years, married 3.5 years before we were seperated, therefore I am not worried about them asking if our marriage was legit. I have my 10 year GC and know that i cannot apply to be naturalized til 5 years because i will be divorced legally by the time i apply for it anyways. (although i'm not sure if i want to apply to become a USC. I may want to just stay as a PR and keep my citizenship with my home country)

Your "p.s." is the most important part. You have a 10 year gc so...

a. Yes you needed to file for a change of address within 10 days of moving... obviously WELL past that. You need to file IMMEDIATELY.

b. No.

c. No.

If this was a 2 year card the answer to "b" would be yes (because you need to file ROC immediately after divorce) and then "c" would be maybe... depends on when your GC expires.

Also, no need to become a USC but applying for USC doesn't always mean you'll lose your home countries passport. Several countries are find with dual nationality but yes, some are not.
