Sorry to hear you are going through this. Thought I would give some feedback re: home visits.

I had problems during my AOS and had no idea why (long story, but to keep it short found out later that someone sent USCIS a complaint about us).

Before I even had an interview appointment I received a home visit at 6AM. I wasn't prepared for something like that AT ALL and let them in without even thinking I had the possibility of not doing so; I was alone too because my husband had already left for work. Anyway, despite not finding my husband, they must have thought everything was in order because when we finally got our interview it was very easy and short. This is just to say that letting USCIS people in doesn't necessarily always mean giving them a reason to deny you if you're in a genuine marriage :)

That said, still hope it doesn't get to that in your case and that things get better soon for you guys.

The fact that she goes back alone to her hometown every week-end may seem highly suspicious for an IO: you only live together 4 days a week, and you never spend your week-ends together, it almost sounds like room-mates (in the IO's eyes).

Ok i get that, however, when we say hometown I know it seems like we get apart for hrs n hrs of a drive, when i have days off thats the place i go, I lived there for 9 years, so is not like we say "oh i have to fly back home", its very normal for us to go back and forth, it isn't really an issue at all.... Now she's here in LA because of me... she doent like that traffic and likes seeing her family which is completely understandable i think... but this is no secret since we told all this to our IO's we didnt try to paint a perfect couple to anyone's eyes at all... I dont think there is such a thing a PERFECT couple out there.... We told our IO how our relationship is without adding lies at all... I though the interview was going to be to show that we are in FACT a couple, not what kind of couple we are...

What visa did you use to come into the USA?

Thank you for your input, i mean yeah i we wouldnt have any problem letting anyone in, I dont think anyone has anything to say about us at all... but you just never know....

Working illegaly is USUALLY forgiven when adjusting staus through marriage to a USC.

Jim, do you have statistics on this?
hire an attorney. Make sure the attorney is willing to come to your home any time, day or night, if immigration officers show up at your door. If the immigration officers do come then tell them they have to wait until your attorney arrives.
Jim, even if the attorney isn't available around-the-clock like that, it would stand to reason that the OP could say something like, "Agent ___, I realize that you're just doing your job, but in general discussion, my attorney told me never to consent to a search of any kind at any time. You're welcome to come back when he's available. What hours today are good for you?"

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

the reason we didnt end up getting married back in 08 is because i lost my job, i had no mobey to go through with it, and well yeah she goes back home alone, she stays with her mom... but if i have the time off i go back with her too... we dont have any type of jealousy issues so i deff dont have any issues w her going back, specially to see her family... and well km not doind any stupid moves at all... im just waiting for some type of outcome so i can then do something like gather more evidence or id would be great if they at least told me what they need to proceed... another thing is that we didnt even file right away bacause we didnt have enough money, se we ended up filing like 5 months after, not even rushing anything at all...

Like the other member said,I don't doubt your relationship, but the fact that she goes home alone could be a red flag, why without you?is she having an affair? Is she working illegally? Are you guys faking the marriage? Those are the type of questions that comes to an IOs mind after being told all this. Don't take the things we or the IO says personally, because to them, everyone is committing fraud unless you can prove otherwise

oh no, i def dont take it personal, cus i know this is process and things need to be a certain way, completely understand, what im saying is that we told the truth and explain the kind of couple we are... we didnt lie nor try to make us look like best and most amazing couple there is... but i really appreciate everyones replies rrally... it helps me see things how they are amd my possibilities... i think wifey n i are ready for any outcome at this point... i kno she'll b w me so... thankx everyone for ur input... please keep it coming its really helping a lot...
