Hi everybody. I'm currently a graduate student and have no steady income. I stopped working in July 2011 and am currently living on loans. I am filling out the I-134 for my fiance's K-1 visa interview this Friday at the London embassy. At the moment, I have my 2011 and 2010 tax return and the associated W-2's. I also have pay stubs from last year. My mom is filing as my co-sponsor, though I still have yet to get the paperwork from her and probably won't receive it until the last minute.

Here are my concerns:

1) What are the chances that our visa will be denied based on the following info?

- I was unaware that the Statement from the bank required for the I-134 takes between 24-48 hours. Worst case scenario, if it takes 48 hours, we will have the official bank statement with the total amount, the total deposits and when the bank accounts were opened but the interview will be over.

Options: I can print out my bank statements for the past year, although I opened the bank accounts from way before then and have no ability to gain access to that information in time for the interview.

- I have no income information from after July 2011 because that is when I stopped working. I do have random pay stubs (random because I expect some stubs will be missing) and the W2's from 2011 and 2010, however.

- I have loan acceptance letters.

- Budgets for myself and my fiance with expected expenses, savings and income to the end of December 2012. Though I am a student, I also have a freelancing gig in the summer and an internship stipend in addition to the loans.

- I have my mother, who is co-sponsoring us. She will fill out the I-134 and at the very least, will have the following by the time of the interview: unofficial bank statements with total amounts and the 2010 tax return. At the most, by the time of the interview she will have: an official bank statement showing the date the account was opened, last year deposits and total amount; a statement from her employers; 2010 and 2011 joint tax returns.

2) If there is a high chance of rejection, will he be notified at the interview or after? What is the appeal process? How long will it take and what additional forms or fees will be required?

Please let me know what you guys think. If we get approved, I stay in school and he moves here and we build a life together. If he gets denied, I'm dropping out with thousands of dollars in debt and moving to England because I'm sick to death of this process.

How did he miss the part about having everything in hand for the interview before he mailed in the DS-2001 saying he was ready to interview? And how will you get signed documents to the UK before Friday?

You are worrying a lot about things that don't matter. Don't prove your old income. If you don't make any money currently, then London doesn't really need anything from you. Mom can be the sponsor.

London will be fine with Mom's (original) signed I-134 and just a photocopy of her latest tax return +W2 or an (original) employment letter.

He will not be denied over the I-134. He may be delayed if he doesn't show up with an affidavit of support from somebody with adequate current income.

Nick: Thanks for your response. I'll be emailing him scanned copies of mine and my mom's signed I-134 and bank statements and my mom's employment letter.

They may let you by without the real I-134, but normally forms and letters must not be photocopies. Post back what happens because I'm curious.

Edit: Just noticed your NOA2 is probably expired. Did they tell you to do a new letter of intent? It is sometimes asked for if you delay getting things in. Your timeline doesn't say when he sent his application forms. Probably fine since it just expired.
