Timeline

We are filling out the application for my wifes mothers tourist visa and I have a question where it shows what immediate relatives she has in the US.

My wife and I just got married 12 days ago on a K1 visa. We just applied for SSN and we are just getting the AOS papers together. What is her status? legal US permanent resident, non-immigrant or other/I dont know?

technically she is a permanent resident with her k1 and us being married now?

We just aren't sure.

SHe is not a permanent resident until she has her Greencard.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

There is no technically anything about her being a permanent resident. She is not if she does not have a green card. She is a K-1 who is SEEKING to adjust her status. The AOS is not automatic so that is technically why she IS NOT A PERMANENT RESIDENT. She becomes a permanent resident only when USCIS approves the AOS and gives her a green card.

List her as K-1 visa holder or K-1 filed for AOS.
