well, if you set an appointment at the local USCIS office, and asked for the ICE section head, then you'd be having a convo with an ICE agent.

Otherwise, no.

VAWA stuff? they never contact you - it's on the applicant to handle that prove-up.

as to 'the process' - uhm - what process are you attempting, exactly?

I've contacted ICE out the wazoo and heard zilch back. I made an appointment and went to USCIS and they said that due to confidentiality they cannot say anything. What I did hear from ICE was that an investigator most likely will corroborate the story from my side. Like I said I have a ton of rock solid evidence.

As for the second question, how long do VAWA investigations take? 1 year? 2 years? How soon would she go before an immigration judge?

What I did hear was that even if she gets a letter of Removal Proceedings it will be a long time before they actually go after her and deport her. As before I realize only about 20% of VAWA petitions are rejected. Hard to believe that of roughly 2500 annual self petitions only 800 or so are rejected. Anyone have real life accounts of rejections and why?

well, if you had a face to face meeting with the ICE shift supervisor at the local USCIS office, and passed over all of your evidence to HIM, then you've done about as much as you can do.

If you only asked questions of said ICE officer, you've not done enough.

Yes, I handed over tons of evidence. Thanks. I double checked the stats for self-petitions, it's about 8000 approvals and about 2000 denials a year. I am praying for justice.

did the ICE Shift Supervisor give you a case # for any fraud case? If not, call back, or go in person, and speak with that human again.

No, I did not. I was told the case was under strict confidentiality wraps per standard VAWA language. I was told by ICE that putting more information in the system would actually slow their investigation. I swear they told me that (like if you give us more stuff it's more work for them!).

Q. What training do supervisors in the Unit receive with regard to adjudicating VAWAs/T/Us and the specific issues that come up in these cases?

A. Supervisors receive the same training as adjudicators. VAWA Unit adjudicators initially receive four days of classroom-type training regarding basic eligibility requirements for special immigrant status under VAWA, protections and prohibitions under Section 384 of the Illegal Immigration Reform and Immigrant Responsibility Act (IIRIRA) (which prohibits an adverse determination of removability based solely on information provided by the abuser and requires strict confidentiality in VAWA, T, and U cases) and processes for adjudicating Form I-360 special immigrant petitions under VAWA.

you talked with an ICE human or a special VAWA human? you need an ICE human if you wish to open a fraud case on her. It'll be YOUR case, not hers.

A VAWA case is HER case, not yours.

A fraud case is YOURS, not hers.

Somethings mixed up here, much.

Yes, I have an open ICE case for fraud, but I don't have a case number. They haven't called me in a year even though I've sent them like 6 letters by FedEx and contacted my congressman. I opened MY ICE case many months in advance of HER VAWA case.

I totally agree with you! I was in a extremely abusive relationship for 6 years (so much so I had a heart attack when I was 23 years old, only 2 years ago!!) and there is no organisation for men victims. Its a niche market but it still exsists damn it! lol!

Disturbing new development. A family member of my ex-wife called me and said they lost contact with her. They don't know where she is living but that she might be in beauty school. What I also don't know is how she would have the money for that and how she could get enrolled and after that even legally work.

I still cannot imagine even with all the fraud proven with all the evidence that her VAWA petition would be approved. Bizarre..

I'm sorry, something is really amiss here (on yer side)

as

you've no indication that ICE has a casefile on her.

Just so you know, VAWA covers men too. The name isn't exactly right, but the law itself does not discriminate against gender.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

You supposedly have ICE case open, but don't have a case number? Something is really amiss here.

I actually got through to real live people yesterday! It appears that this case was handed off to USCIS-HSI for fraud investigation. I am waiting for a call back from the investigator. Of course I can get NOTHING from VSC VAWA unit.

In the meantime the mother has gone back in to hiding with an unknown "benefactor." Indentured servant? Prostitution? I'll keep after this...
