If not, you may want to look into doing what you can for the sole legal custody. In most states, this is essentially proving the woman is an unfit mother and stripping of her of any rights to the child. It can be difficult as 'unfit' is difficult to establish (mothers who are drug addicts routinely lose physical custody but retain legal custody) and 'unfit' will be in the eyes of the Court, not what you perceive to be 'unfit'. Still worth the expense of a 60m consult with a good family attorney.

Reminding everyone of a few facts. I had a 1 1/2 year courtship with a woman I loved with all my heart who was cheating on my while pregnant and was engaged in pornography on the 4th day of marriage while 8 months pregnant. That is a FACT. I simply caught her in a scam. I didn't call her names or every hurt her. I gave her 4 1/2 months of motherhood and 6 months of marriage to straighten up...She did not. Divorce served. Yes, I monitored her actions per her family and her agreement. If that is VAWA, well then that just stinks.

I would say anyone should use whatever rights are available to them, whether they come from a communist country or not. If the Court says she has rights then she has rights; your perception is irrelevant. If you feel you have enough evidence to limit her rights or have them terminated entirely, then proceed in that direction.

What is truly a shame is how long it takes to get adjudication. It just keeps dragging along and dragging along. It is fraud without a doubt. Unreal. It's cases like these that make VAWA a joke. Thousands of scamming women AND men from around the world breaking hearts and bank accounts of US Citizens and many of them getting away with it. So unfair to the truly abused and more unfair to the broken hearted and broke USC's who are victims of this BS. Yes, it is BS.

The P6c1 is administrative short-hand for a pending finding of INA 212(a)(6)©(i)^[5]material misrepresentation by a visa applicant. The justification DOS uses is found at 9 FAM 40.63 note 10.1. I'll quote it here, and I'll add emphasis to the deadly part.

9 FAM 40.63 N10.1 Misrepresentation in Family Relationship Petitions (CT:VISA-1030; 09-22-2008)

Pursuant to 8 CFR 205, invalidation of a labor certification for fraud in accordance with the instructions of USCIS or the Department of State automatically revokes an employment based immigrant visa (IV) petition. On the other hand, USCIS retains exclusive authority to disapprove or revoke family-relationship IV petitions. Thus, a misrepresentation with respect to entitlement to status under a family relationship petition, e.g., document fraud, sham marriage or divorce, etc., cannot be deemed material as long as the petition is valid. Upon discovery of a misrepresentation, you must return the petition to the appropriate USCIS office. If the petition is revoked, the materiality of the misrepresentation is established.

Fraud is a crime and/or civil litigation option.

P6C is a USCIS determination of material misrepresentation that declines a visa and could subject the beneficiary to a ten year exclusion if I'm correct.

This is clearly my ex.

Now the question remains if VAWA pardons her of all her wrongdoings, or USCIS puts some real muscle behind excluding scammers from obtaining LPR status.

I've said it before, and I'll say it again.

Obama, et al, have said, let's get innovators and inventors, entrepreneurs and engineers visas and legal status. I don't think "immigration prostitutes" (yes I found this term on a VAWA fraud website) qualify as great LPR's for the USA as a general rule.

I cannot take my ex to court without someone finally designating her as a fraud. For now I am just a sucker.

Also, I cannot sue or request child support because I accepted a negotiated deal for 100% physical custody with her getting a payoff. Basically, she sold her motherhood, but not her rights to visitation.

Yes, I want to but she will continue to take money from us if she can. More importantly she is a threat to my child's upbringing. She is a LIAR. She will always be a LIAR. I try to be as patient, loving, supportive, giving opportunities, and enriching the life of my daughter as much as I possibly can.

Mom is generally always going to be hanging on...just trying to keep that small as possible and monitored. Pray for justice here on earth, from God above, and by whatever karma exists in the universal balance of life.
