sir : your information is wrong we have 3 cases of "successful cousin marriage" in my relatives in Texas/Houston

note*** I don't want your help sir

Please don't get offended so easily. Not everybody is knowledgeable of your culture, so it is an opportunity for all of us to get educated on your culture. I don't think Harpa Timsah was trying to "diss" you. He/She just pointed out what they thought was the case in Texas. If someone is wrong, please correct them without getting offended so that all of us can benefit from this forum.

Thanks,

I think the most important thing to establish here is if the federal government will honor state law in the case of cousins marrying.

For example, gay marriage is legal in New York, Massachusettes (sp?) etc, but we all know that USCIS will not approve gay marriage for immigration. So, first we need to find out if there are any married cousins who have successfully gone through the immigration process, and got green-cards. Anyone out there who knows anyone who got green-cards through cousin marriage?

Also, I think it would be better to get married in Jordan then file, cozI don't see why the USCIS would frown on cousin marriage done in Jordan when it is culturally acceptable in Jordan.

This page http://marriage.about.com/cs/marriagelicenses/a/cousin.htm

and this page http://en.wikipedia.org/wiki/Cousin_marriage

and this page http://www.cousincouples.com/?page=states state that couples cannot marry in Texas. Even if you were to marry elsewhere, USCIS will not confer marriage immigration benefits to couples who live in a state where their marriage is illegal.

Why don't you want my help?

my friend I am sorry for my bad reply ,,,I apologize

The issue for USCIS, as I stated, is that the marriage must be legal in the state in which the couple resides. They could get married in another state or country, but they cannot get any immigration benefits from the marriage.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

here is the official response from USCIS http://www.uscis.gov/ilink/docView/AFM/HTML/AFM/0-0-0-1/0-0-0-3481/0-0-0-4484.html

"© Marriage Between Close Relatives .

In some foreign countries, and some states in the United States, marriages between close relatives (e.g., cousins) are permitted under certain circumstances. In cases where such marriages do not offend the laws of the state where the parties reside, the marriage will be recognized for immigration purposes. "

There is a clear answer- as long as you reside in Texas, the cousin marriage will NOT be allowed for immigration purposes. If you move elsewhere, it will. You cannot just go for the day to a state where it is allowed. In the case of the marriage that happened in Jordan, because it is allowed there, the USA accepted it.

Okay. Here's the issue. IF in the state you live in it's illegal, then USCIS will not permit her to immigrate. So if you plan to do this she will need to move to another state were it IS legal and petition you from there. It's likely your cousins didn't live in Houston at the time. Are they also first cousins or are they second cousins? This makes a difference. It also makes a difference that it was a CR-1 application. If it was AOS in the US then they're forced to go by state laws that wouldn't permit it.

Read this: http://en.wikipedia.org/wiki/Cousin_marriage#United_States_2 There's a little map on the side that says first cousin marriage in texas is a criminal offence... so I wouldn't go around advertising it if I were you.
