The wife beating A hole is doing more behind closed doors than what most think why she got fed it with him and exposed him on tv media.

Qualifies as wife-beating to me.

Says the guy who held off on helping his wife buy another car after she wrecked hers. I mean isn't that "imprisonment" ?

How so?

That guy is a big fan of Moonbeam Brown and all that other Bay Area lib #######. If one of those Bay Area loonie politicians say it's so, he's taking it as the written word of god.

If you grab your wife so hard it causes a contusion, that is an assault, just as much as if you struck her a blow that caused a similar injury. If you see a difference in those two actions, you need to enroll in anger management tonight.

So if I took a video of my arm with a bruise and said that my ol lady did it she would be guilty of DV correct? I mean nobody lies about this stuff, and a bruised arm is right up there with near amputation.

You could file a DV complaint. Juries (and Judges) determine guilt or innocence.

For Alaska:

Sec. 18.65.515. Duties of peace officer in a crime involving domestic violence

(a) A peace officer investigating a crime involving domestic violence shall protect the victim and any member of the victim's family and prevent further violence by

(1) transporting an adult victim and any member of the victim's family from the place of the offense or the place of contact, to a location within the community where the offense occurred that is a shelter, a safe home, or another location in the community requested by the victim;

(2) assisting the victim in removing from the residence essential items belonging to the victim, such as clothing, vehicles, medication, personal records, and legal documents;

(3) assisting the victim and any member of the victim's family in obtaining medical treatment necessitated by the offense, by contacting emergency medical services or by transporting the victim to a local medical facility, if available in the community where the offense occurred; and

(4) providing notice of the rights of victims and services available to victims of domestic violence as provided in AS 18.65.520 .

(b) If a peace officer investigating a crime involving domestic violence determines that it is necessary to protect the victim or the victim's family from domestic violence or to protect the officer or the public during the investigation, the officer may (1) seize a deadly weapon in plain view of the officer, and (2) if a deadly weapon was actually possessed during or used in the domestic violence, seize all deadly weapons owned, used, possessed, or within the control of the alleged perpetrator. If the weapon is not needed as evidence in a criminal case, the law enforcement agency having custody of the weapon, within 24 hours of making the determination that the weapon is not needed as evidence in a criminal case, shall make the weapon available for pickup by the owner of the weapon during regular business hours.

Sec. 18.65.530. Mandatory arrest for crimes involving domestic violence, violation of protective orders, and violation of conditions of release

(a) Except as provided in (b) or (c ) of this section, a peace officer, with or without a warrant, shall arrest a person if the officer has probable cause to believe the person has, either in or outside the presence of the officer, within the previous 12 hours,

(1) committed domestic violence, except an offense under AS 11.41.100--11. 41.130, whether the crime is a felony or a misdemeanor;

(2) committed the crime of violating a protective order in violation of AS 11.56.740;

(3) violated a condition of release imposed under AS 12.30.016(e) or (F ) or 12.30.027.

(b) If a peace officer receives complaints of domestic violence from more than one person arising from the same incident, the officer shall evaluate the conduct of each person to determine who was the principal physical aggressor. If the officer determines that one person was the principal physical aggressor, the other person or persons need not be arrested. In determining whether a person is a principal physical aggressor, the officer shall consider

(1) prior complaints of domestic violence;

(2) the relative severity of the injuries inflicted on each person;

(3) the likelihood of future injury from domestic violence to each person; and

(4) whether one of the persons acted in defense of self or others.

(c ) A peace officer is not required to make an arrest under (a) of this section if the officer has received authorization not to arrest from a prosecuting attorney in the jurisdiction in which the offense under investigation arose.

(d) When investigating a crime involving domestic violence, a peace officer may not threaten or suggest the possible arrest of all persons involved in the same incident in a manner that would have a tendency to discourage requests for intervention by law enforcement in incidents involving domestic violence.

(e) In addition to the contents of any other report, a peace officer who does not make an arrest after investigating a complaint of domestic violence, or who arrests two or more persons based on the same incident, shall describe in writing the reasons for not making an arrest or for arresting more than one person.

(F ) A person may not bring a civil action for damages for a failure to comply with the provisions of this section.

For Alaska:

Iv'e been through the process in Alaska (Anchorage) and I know exactly how it works. Let's say hypothetically that my wife thought I screwed one of her best friends when she was out of town on a work trip. So she calls 911 while I'm watching the ball game and says I threatened to kick her #######. So the cops show up out of nowhere and start asking me questions. She lies and says I chased her into the bedroom threatening her with violence if she didn't shut her yap....oh and that I took the car keys away from her. Let's not forget that. So the cops take me to jail and book me on a DV, I have to pay bail money and the state here requires a Restraining Order seeing how it's the law on any DV related crime. So I can't go back and grab my clothes without making an appointment first with the Alaska State Troopers...count on 5-7 days for that happening so all I have is the clothes on my back and I'm looking for a place to stay not to mention I have to go to work the next day and the process has taken around 6+ hours from, the time the cops showed up to the time I was actually released. Then to make it even better she cleans out the bank account so I'm stuck with a public defender and not a real mouth piece. So in court seeing how I have a record...no DV's then, but a record and it's a he said she said.... I'm found guilty and have to go to 6 months of don't beat your ol lady classes. In the meantime she goes to court to drop the restraining order...but only after the states required 1 month is up. But I still have a DV conviction on my record.

So move up the clock a couple of years and were split up and fighting for a house, land, cars, etc... I'm working at the Valdez Oil refinery which happens to be a 45 min flight from Anchorage, or a 6 hour drive. Seeing how I'm putting in 7-12's on a 2 on and off rotation it's highly unlikely I'm going to drive to Anchorage on a work night ...especially when my truck is in Anchorage to begin with. No need to drive if your flying. So she knows when my two weeks off are and she calls the cops and says I hit her outside of a bar, but what she doesn't know is that I traded hitches with a guy and stayed an extra two weeks in Valdez working. I get picked up a few months later on DV charges and I'm like "#######"? I take it to court, she gets caught lying but the court does nothing to her other than put a red flag on the file showing how she lied. But after I got arrested I was booked, had to pay bail and put on third party custodial release which means I couldn't work in Valdez anymore and I lost my job. Again nothing happened to her even though she was busted for lying.

So to say this Frisco cop grabbed his wife's arm so hard that it bruised when there were ZERO witnesses yet he still gets arrested and thrown into jail is what? Justice served? Is that what it is? Justice when it's his word against her word? Now Frisco is trying to get him fired even though they don't know what actually happened if anything. And the neighbor she sent the vid to is running a website for this Frisco sherrif trying to save his guys job.

Unless you were there and saw it with your own eyes then who knows what happened. All too easily the over politically correct nut jobs who are willing to jump on any bandwagon have this guy tried and hung. I mean who wants to take a chance of being wrong with the OJ thing.

so if I am reading this correctly, the wife didn't file the charges the neighbor did... and the wife and the neighbor took the video in case there was issues with child custody..

According to the few articles I read on it, the argument was over her leaving back to Venezuela with the kid. She's still going through the visa process here to get her permanent green card, etc... She's from Venezuela and is a well known actress/movie star there.

I was convicted of beating my wife with a tube steak.

Yes, 'to grab' is assault, however, assault was never the argument. Regardless of how you try to spin it or comprehend it, 'To grab' your wife is not the same as 'to beat' your wife.

Maybe in the fantasyland of Northern CA., 'to grab' someone is the same as 'to beat' someone. To "grab" is not the act of hitting. You ever beat another man's a$$ by grabbing him?
