Denied entry due to expired Visa...what now?

My boyfriend left the U.S. to visit his home country of Germany with an expired Visa. When he tried to return they wouldn't allow him into the U.S. How difficult will it be for him to get a Visa to come back?

I really think you can't get a answer until you give some facts:

What sort of Visa? There are alot of Visa catagories. Which One?

The Denial of Re-Entry to the US can be Serious. So whats the full story about the "Boyfriend" and let Members help you.

I find the question incomplete but there are people who can answer (opinions) with alittle more input.

12/21/10 ....Received hard copy,NOA1
5/25/11.......Received RFE
6/09/11.......NOA2 approved
12/07/11.....Visa fee paid at BPI
6/11/13.......2nd visa fee payment
7/10-11/13.. Medical Exam completed@St.Lukes Clinic
1/15-16/14.. 2nd Medical exam updated
1/21/14...... k1 interview-Visa Approved

01/07/15.....Received my EAD card

01/31/15..... I got my SSN from the mail

OP, no, boyfriend can't come back as he clearly violated visa rules. He at least has a 10-yr ban. It could be waived but you don't have a petition-able relationship - only fiance or spouse would work and YOU have to prove to the government it would be a hardship to you if he were not to return.

A friend of mine left the United States for a short visit to his home country of Germany. He was aware that his green card was expired but didn't think he would have a problem returning because he had served in the U.S. Military and had discharged only a few months ago. He recently tried to return and was not allowed entry. What does he need to do now and how long will it take? Does anyone out there know?

Thank you ALL for your answers...I am very grateful. My understanding now is that he must not have a visa but rather a green card since he served in the Marines. His card expired in November 2011. He left for Germany on February 21st. I just learned that he did not even take his expired green card with him. He is trying to do what he can on his end to get back here. I'm just hoping someone here can help me to help him figure out what to do and how long this could take. We are not married but I am pregnant and desperate for him to come home.

He needs to contact the US Embassy in Germany. They are the only ones that can help him.

Why would he even let his GC expire in the first place? He should have applied for a renewal several months prior to the expiration date. Just because he served in the military doesn't give him special privileges he still needs to prove his LPR status upon re-entry. You mention he did not take his expired GC with him to Germany so what did he use to enter the US? If and when he gets back into the country he can apply for form I90 to renew his expired GC which could take up to 6 months.

I believe this is his first trip back to Germany in many years. He should've applied for renewal of his GC many months ago, but frankly I'm not even sure he realized that it was expired until he had scheduled his trip to Germany, and then decided to go anyway thinking it would not be that big of a problem. He might have thought his military service would give him special privileges...I'm not sure. :-(

Why he didn't even take his expired GC with him, I have no idea. I will tell him to go to the U.S. Embassy...thank you all again for your responses.

Green cards or passports are not to be sent via mail.

Can you provide a citation for why not? I can't find any indication that it would be illegal to mail either document.
