Hello, can anyone give me some advice on I-130 questions sending out this week . I am newly married to my Moroccan hubby and filing the I-130 then to follow with the K-3 afterwards. However I just found out I am 3 weeks pregnant and want to know is it to be mentioned to the USCIS in my cover letter and also should I get now a doctors note before sending the application, or do I send it at the same time? I ask this cuz I won't have it. however I was told that the USCIS should know of the baby due to it proving a bonified marriage. Along with my letters of course from friends and family. Also towards the bottom of my I-130 right corner there is a date of 1-8-12 apparently it's an updated version of the form still being used by the USCIS however the directions attached say to mail to phoenix if living in Florida and I thought it would be going elsewhere??? Anyone heard of that Phoenix spot is it new, also it gives 2 address options to mail the application too regular mail to a PO BOX, & express mail to a live address. Which is better live address or PO BOX , I like the live address option better. All comments and expertise is greatly appreciated Thank you!!!

Just to point out a couple of things though.....

Don't bother filing for a K3 - that visa is effectively dead. Stick with the CR-1.

Congratulations on your pregnancy. I'm sure the fact that you are pregnant will come up at some stage during the process, but be aware - being pregnant doesn't necessarily prove you have a bonafide marriage.

About the address..... the Phoenix address is just the filing address for the paperwork; the file will be forwarded to the appropriate processing center for the state in which you live (For example -when we filed in 2010, we sent the petition to Chicago and it was then forwarded to CSC (California Service Center).

One last thing....your best bet when sending any paperwork during this process - send it via a method which allows tracking of the package and requires someone to sign for it. That way you can better keep an eye on things and make sure they are delivered.

1 Dec 2010 - I-130 received at Chicago

18 Apr 2011 - APPROVED!! NOA2 text and email

NVC

29 Apr 2011 - Case entered into the system/Case number assigned; Medical Exam in Sydney

30 Apr 2011 - Police Check Application sent

2 May 2011 - Called NVC and got Invoice ID number

3 May 2011 - Sent DS-3032 email

4 May 2011 - Received email reply from NVC for DS-3032; Received Medical Exam results

5 May 2011 - AOS invoiced and paid

7 May 2011 - AOS package sent; IV invoiced and paid

9 May 2011 - AOS package delivered to NVC according to tracking

20 May 2011 - RFE for missing IV package....still waiting on Police Certificate!

24 May 2011 - Received Police Certificate after 25 days (so much for 7-10!); IV package sent

27 May 2011 - IV package delivered according to tracking

8 Jun 2011 - RFE for original marriage certificate; requested supervisor review since we KNOW it was in the package!

30 Jun 2011 - SIF and CC - FINALLY!!!!

13 Jul 2011 - Interview date assigned! Scheduled for August 9th @ 10am

9 Aug 2011 - Interview - APPROVED!!!!!!!!!!!!!!!!!!!!!!!!!

12 Aug 2011 - Visa in hand

24 Aug 2011 - POE @ LAX

Agree with KLS, pregnancy doesn't mean bonafide marriage. USCIS doesn't recognize unborn children. So keep all that evidence until later. The only real impact it will have is increaseing your household size for the I864 and the amount of income you are required to make.

Forget the K-3, the I129F will not result in a visa for you

As others have pointed out this does not prove to the consulate that yours is a bona fide relationship. Read your guides on here for the Spousal Visa and keep up with the past posts in MENA. It will open your eyes to what is ahead.

Others have given good answers already. K3 is dead. Even in its last years, it didn't save time from filing to visa.

Where I disagree somewhat from the other answers is regarding the pregnancy. While no "evidence" actually "proves" a bona fide relationship, pregnancy IS a piece of evidence. For Morocco, it can be a very IMPORTANT piece of evidence among the many others to be evaluated at the interview. Be aware that USCIS will not make any VISA decisions. They simply approve your petition, which allows your husband to APPLY FOR a visa.

I would provide evidence of the pregnancy including a conception date that shows the child was conceived during a time frame that you can provide evidence you were together in person at the time. It's worth waiting a few days or a couple weeks for, so that the Consular officer can consider it prior to the interview.

Facts are cheap...knowing how to use them is precious...

It is all God's will that they are pregnant. I am happy for them...

But with your advise on giving date of conception to help...does it fall under being a positive in CO mind, if it was BEFORE the marriage? I am not the greatest in math but OP has given the amount of weeks she is pregnant and her marriage date...

Just playing :devil: advocate. Ahhh CASA.

I didn't do any math. As in any country, moral standards are inconsistent. No judgments here. Consular Officers will tend to expect people to live by their own moral standards rather than some perceived norm.

Thank u everyone for yr advise. I had my last cycle the 23rd of February it lasted 5 days We were married the 2nd of march it had to happen between the 2nd and 8th per conception calendar . As for the both of Us Rabie n I we planned this cuz we didn't want to wait for our family. However when to let any office aware of the child is really what's important whether we should or not? Makes sense that it will cause my need of income to rise up that's a good point!!! However I can see also Morocco as other countries being morally correct or is that my hopes lol God IS in control what will be will be is right no worries. Thanks again all y'all !!!

You are married. Blessed with a baby and I hope you the best.

Yes this too about you adding one more to the family for the affidavit of support was good point.

But stay peacefully focused on yourselves and keep reading the Guides on here for all your filings. Your far away from the interview and many things that you will think of by then to present to the consulate

Please realize that the visa decision will be made at a US Embassy's Consular Immigrant Visa Unit but a US State Dept. Employee. Morocco, is not under strict Sharia law, so there will be inconsistent moral standards observed, even in the open. That your conception occurred AFTER the marriage, DOES avoid the potential complication mentioned, that fact has little to do with how your relationship will be viewed in terms of bona fides. Consular officers do not impose any religion's moral code in determining bona fides, but they do "consider" cultural norms. When something is outside cultural norms, there will be questions and the answers need to be satisfactory. It doesn't sound like you have any issues there but if someone in your situation HAD conceived prior to marriage, the answer, "I/we do are not strictly religious" would be a satisfactory answer, unless the visa applicant was a woman in a burka.
