my husband has not yet registered me, we've only been married less than a year and didn't know we need to do this for him to come to America??? so if i'm not registered with spain, he won't pass the interview???

What uncle Darnell says is that civil documents are ONLY needed for the APPLICANT = the foreign spouse.

The US Citizen doesn't send any papers in the IV package.

CR1 Visa

USCIS STAGE: 16 days No expedite request but USC residing abroad
NVC STAGE: 19 days from case # to case complete
03/27/12: interview at Paris embassy - APPROVED
04/12/12: POE San Diego

05/14/14: received card production notification by e-mail, approval date 05/13

Naturalization

02/01/24: N-400 submitted online; Biometrics reuse notice received immediately online; "case being actively reviewed" after a couple hours

04/08/24: interview scheduled for 05/14. Received "We have taken an action in your case" email.

i understand this, but my question wasn't about my sending papers, but about the fact, that spain asks for a civil document in which you are listed as single or married, we are not yet registered with the spanish government, so he will show up as single. however, the us marriage license is proof that we are married...

I am not sure what this civil document is that you are referring to. However, when you got married, you must have received a marriage certificate. You just need to send that. You wouldn't need to get your marriage registered in Spain unless that is needed for some other documentation.

it occurs that i never really got the answer i needed, we are not registered in spain, so my husband is still listed as single in spain, he needs the civil document from spain, which he has to renew, but how can he if he's listed as single? will our american marriage certificate suffice as proof?

Is he registered in a census? If yes, does this certificate has an expiration date? If yes, was it before your wedding? If yes, then I think he does need to renew it as been marrried. If it has not expired then I don't think there's a problem. Double check with your husband and find out if he's registered in a census. If not, then you don't need it since it is ONLY available to those that are registered.

What is this "Census" about? Is it like our census? Have you called NVC to ask about it? How about emailing those people that already completed the process and got a Visa?

I'm guessing that this Certificate you get before getting married to prove that he was single/divorced and was able to get married, if he didn't do it then you don't need it now. For example, in India it is recommended to get an Affidavit from the Embassy stating that we are single/divorced and can be married in India. Sorry, I can't be of much help :blush:

The marriage certificate is all you need to prove that he's married.

Ooops, I dint' read this part. Can he take a copy of your marriage certificate to renew his certificate? YOu can send him the original or the extract of your marriage certificate -you will wait for this Doc anyway to submit everything to NVC.

followed your advice and found some very very helpful spaniards, who unanimously confirmed that NO we do not need this because we have a marriage certificate. thank you again, and if we did register it would take months, so the others didn't we won't either! thanks for your concern, keepin the process moving, IV should be out by end of this week :-)
