NVC processing for family - different information

If her son was a child born from their marriage she wouldn't even need those forms, only his american passport.

Not all the time. USC parents can automatically pass on citizenship to biological children only under certain criteria. Residency is one - the USC must have lived in the US for at least 5 years, 2 years of which have to be after the age of 14, and must be able to prove it.

Like my husband, he was born on US soil but grew up in the Philippines. That makes him a USC by birth, but our child is not qualified for a CRBA or a US passport because my husband hasn't fulfilled the requirements for residency.

USCIS

10/01/11 - Filed (2) I-130's

10/04/11 - NOA-1

04/05/12 - NOA-2

Your I-130 was approved in 184 days from your NOA1 date.

NVC

04/23/12 - NVC received both cases (18 days/12 business days from NOA-2)

05/07/12 - Case numbers and IIN's (14 days/10 business days since NVC received)

05/07/12 - Sent out DS-3032 by email; auto-response received

05/08/12 - AOS fee invoiced, paid - "IN PROCESS"

05/09/12 - AOS fee shows as "PAID"

05/10/12 - Spouse's DS-3032 accepted; minor child's rejected = had petitioner call NVC = received verbal acceptance from operator

05/11/12 - Spouse's IV fee invoiced

05/14/12 - Daughter's IV fee invoiced, paid both IV fees - "IN PROCESS"

05/15/12 - Both IV fees show as "PAID"

05/16/12 - Sent both AOS and both IV packages to NVC via USPS (expected delivery: 05/19/12)

05/21/12 - All 4 packages delivered

05/30/12 - Received checklist for daughter's AOS

05/31/12 - Sent response to checklist via USPS (expected delivery: 06/01/12); Spouse's case completed

06/07/12 - Daughter's case completed; waiting for interview date

06/14/12 - P4 received: interview date 07/11/12

Embassy

07/04-05/12 - Medical at SLEC

07/11/12 - Interview: APPROVED!

07/14/12 - Visas on hand

POE: 10/17/12

I'm getting ready to submit the IV packet for my wife and step-daughter. I haven't paid the IV fee yet, but we should be getting that invoiced sometime in the coming week. Here's what I have ready to send.

For my wife:

Completed DS-230 Part I and II, part I signed.

2 2"x2" passport photos with full name, DOB, and NVC case # written on back

Photocopy of biometric page of passport

Original birth certificate plus one photocopy

Original marriage certificate plus one photocopy

Original divorce certificate plus one photocopy

Original police certificate plus one photocopy

For my step-daughter (5-years old):

Completed DS-230 Part I and II, part I signed by my wife.

2 2"x2" passport photos with full name, DOB, and NVC case # written on back

Photocopy of biometric page of passport

Original birth certificate plus one photocopy

Now, here are my questions.

Do I need to include a copy of the marriage and/or divorce certificate in my step-daughter's application that I am including with my wife's application?

Do I need to include a copy of my divorce certificate in either application?

Am I missing anything else?

02/21/12 - RFE for both (received hardcopy on 2/25)

02/28/12 - Responded to RFE for both(received by CSC on 2/29)

03/02/12 - NOA2 for both(received hardcopy on 3/8)

03/12/12 - NVC Received both

03/21/12 - NVC case number and IIN received for both & Emailed Choice of Agent for both

03/23/12 - AOS bill invoiced & paid for both

03/26/12 - AOS bill shows paid & AOS Packets mailed for both

03/27/12 - Choice of Agent accepted for wife (sent another for step-daughter via email and express mail)

03/28/12 - Choice of Agent accepted for step-daughter & IV bill invoiced & paid for wife

03/29/12 - IV bill shows paid for wife & IV bill invoiced & paid for step-daughter

03/30/12 - IV bill shows paid for step-daughter & IV Packets mailed for both

04/04/12 - IV Packets reviewed. Checklist issued for Divorce Decree for my wife. Step-daughter's was accepted and her case closed

04/10/12 - Divorce Decree accepted after supervisor review & wife's case closed

04/16/12 - Expedite requested for both cases due to NVC error

04/18/12 - Expedite request approved for both cases and sent to Santiago Embassy

Embassy: (15 days)

04/24/12 - Embassy received both cases from NVC

04/25/12 - Wife went to Embassy for document review. Interview date assigned for both cases.

04/26/12 - Medical Exam for both. Result - approved.

05/07/12 - Interview date for both. Result - approved!

05/09/12 - Received both Visas

05/16/12 - POE Atlanta

WELL I WILL INCLUDE THE CERTIFIED COPY OF MY MARRIAGE CERTIFICATE IN MY KID'S PACKETS, NOW RELATED TO THE DIVORCE, NEITHER ME NOR MY HUSBAND WERE EVER MARRIED BEFORE, BUT IF THAT WAS MY CASE, I CERTAINLY WOULD. A FRIEND OF MINE TOLD ME THAT WHEN THE DOCUMENT YOU SENT WAS NOT NECESSARY, THEY WILL JUST SENT YOU AN EMAIL SAYING THAT TEY RECEIVED EVERYTHING BUT THIS OR THAT WAS NOT NECESSARY, SO IT'S BETTER TO RECEIVE THAT THAN A RFE.

NOW RELATED TO THE REST, EVERYTHING LOOKS PRETTY WELL TO ME, YOU SHOULDN'T HAVE PROBLEMS!Thanks in advance.
