Hello all VJ'ers!

I am currently at the NVC stage and my husband has filed the I-130 for me plus two other ones for each of my children. NVC has given us three case # and I have asked before if it would be necessary to send three DS-230. I actually assume it would because there will be three IV bills payments and three barcoded coversheets generated. Anyways, my husband just called NVC and they told him that just mine DS-230 is enough. He called again and another operator informed that there has to be three...

Has anyone else gone through NVC with family members before? If so could you guys please shed some light here?

BTW, my kids are 8 and 5 years old, so I am also assuming I will have to sign DS-230 part I for them if it will be three DS-230. Please help!!!

It makes more sense that there would be 3 of everything and as I now know, a parent can sign on behalf of the minors.

Ok then why in this world would that operator say that just mine is enough? There's a part of the DS-230 that you have to list who is immigrating with you to the U.S. and of course I listed both kids, so maybe he thought that is enough? :blink:

I think you would need to submit separate IV Packets for each beneficiary. But I think you could ask them to merge your AOS. I've read this somewhere before, that you could pay for the AOS only once, even if you have multiple DS-230's.

You've probably already read this, but at the top of the DS-230 it says "Complete one copy of this form for yourself and each member of your family, regardless of age, who will immigrate with you.

When you fill out your DS-230 make sure to list your two children on question 31a if they will be entering the United States with you. On their DS-230 you can leave this portion blank since they don't have any children or spouses.

Did your husband submit 3 copies of the I-864 AOS form?

Thanks!!! Yes I have sent him the DS-230 for the three of us and I have signed part I for my kids too, I have put by the side of my signature (MOTHER OF XXXXXX)to make it clear. The kids are listed in mine but there's anyone listed on theirs (my husband told me to do like tat too)

Now regarding the AOS, first my husband send them just mine with the kids listed on monday morning, but when he called yesterday afternoon to NVC, he found out that each one also needs a separate AOS, but the fee is just one! So now we are waiting on them to make available the barcoded coversheets for my younger daughter's AOS because he could print off just mine and my older son's from the payment portal. I will make a detailed progress when I am done, keep you updated! The bad thing about this is that NVC should keep family petitions together, just like USCIS. My younger daughter has been invoiced for IV bill on friday, I haven't yet and my older son has been input into the system for futher processing just last friday!!! That has been making me to want pull my hair out, but I'll be patient...

Yes you are right, but just mine and my older son's barcoded coversheet were available at the payment portal, my husband sent my AOS on monday morning, but now he will wait till they make available my daughter's coversheet to send them together!!! It was just one fee PAID.

Also just my younger daughter was invoiced for IV bill on friday, but my husband will wait till all the three fees are invoiced to pay them together and send the DS-230 together too!!! It became a mess since they separated our processing :(

No, the kids are principal applicants and need their own I-864, each form with all the evidences and coversheet, that's what an operator told my husband yesterday...

No, the kids are principal applicants and need their own I-864, each form with all the evidences and coversheet, that's what an operator told my husband yesterday...

I called the NVC and they told me the same thing. I was going off the i-864instr.pdf document which says the following on page 4:

Often a spouse or minor children obtain visas or adjust status as dependents of a relative, based on the same visa petition. If you are sponsoring such dependents, you only need to provide a photocopy of the original Form I-864, as long as these dependents are immigrating at the same time as the principal immigrant or within six months of the time he or she immigrates to the United States. You do not need to provide copies of the supporting documents for each of the photocopied Forms I-864.

The key here is based on the same visa petition. I did have to send in two I-130 petitions which means I have to send in an I-864 for each along with evidence.

So now my question is how do you file a visa petition for more than one person at a time? Not that it matters now.

Yeah, I read that too, BUT, I think it relates to K-1 visas, where kids are considered dependents (in this case of the application), in our case, each applicant or beneficiary has to have their own forms, at least that is what I understood of the whole thing. So each one will always have their own forms and fees, I-130s, I-864s and DS 3032s and 230s, fees paid individually too, except for the AOS. That being said, all of us are principal applicants.

Now I hope you have more luck than I did, our petitions are all messed up... :(

Got the same problem here..my son and got an NOA2 approved 7th of March..our case was received in the NVC 12th of march, ive got my NVC case number right away and yet until now they didnt get in the system my son's case..is this really happening? dont have the same case done in the same time? my husband is preparing for our AOS? does he need to make two different AOS for us? i heard about form I-864W, will it apply to my son? my husband is a US citizen...what are the criterions/requirements to qualify for an I-864W for a child? i need a lot of help here..thanks a lot ive been updated here

Yeah, USCIS has that advantage over NVC, they approve family petitions together. Unfortunately that does not happen at NVC. Like I said before, the last choice of agent I sent was for my younger daughter, and she was the first one to receive IV bill. Mine wasn't invoiced yet and my son was late into being input in the system. And yes, you husband needs to prepare two AOS packets, one for you and one for your son. Think like this, in the spousal visa cases, all applicants are principal applicants, it's not like the K-1 visa where kids can be listed as dependents, so in our case (CR-1/IR-1)all applicants need their own forms. If you sent them an electronic choice of agent, which VJ has a very good sample, put first your case # and name in the subject line. And after that another choice of agent has to be sent for your son, but then you will write either his case # or his USCIS receipt number plus his name, and in the body you write based on the sample VJ has, and in the end when you sign, you put "My name is (your complete name) and I am the mother of the minor listed above". I did like that and it worked very fine.

AOS bill will be PAID just once though, but yes they will have to give you two barcoded coversheets and each one of you will have your own I-864 signed by your husband, all the I-864 will have the evidences too. I don't think your son will need a I-864W, according to what I read on USCIS website. He is not exempted from the Affidavit of Support.

Now pay much attention to the DS-230. You will need two, but you will sign part I in your son's behalf. The only thing it won't be needed in his IV packet I think it's his police records, but check the age in your country and see if he'll need those.

And BTW, the K-3 visa is not being processed anymore, so in NVC they will turn it to CR-1 because you are married for less than 2 years. Your son's will be probably turned to IR-2 (I say that because it happened to my kids).

The child can be exempted (meaning the form he needs for his AOS will be the 864-W) if he can acquire US citizenship immediately upon his entry to the US through the Child Citizenship Act. These are the requirements:

Have at least one American citizen parent by birth or naturalization;

Be under 18 years of age;

Live in the legal and physical custody of the American citizen parent; and

Be admitted as an immigrant for lawful permanent residence.

In addition, if the child is adopted, the adoption must be full and final.

Good point. But when I said he cannot be exempted from the Affidavit of Support (I-864W), I was considereing her case is like mine where the child immigrating with her is the stepson of her american husband. If her son was a child born from their marriage she wouldn't even need those forms, only his american passport.
