Hi All,

My husband arrived in January and we got married in the same month. I finally sent in the AOS paperwork a week or so ago. However, I am confused as to whether I can apply for a social security number for him. I have not fully researched it, but as far as my understanding goes, he cannot apply for a social sec number until he receives his employment authorization or green card?

Does anyone know the answer or where I can find this information?

Any replies are most appreciated. :)

Your husband can apply now. Usually we give it a week or two or three for the social security department records to be updated by the USCIS, but that is about it. However, he cannot work with out the EAD. It will say something like "employment only with DHS approval", on his SS card. That approval is the EAD.

there are states that allow you to obtain social security number using the I-94 as long as it is not yet expired and it is 14 days after his arrival in the US soil and you are not yet married. Since you are already married, i think it is best to wait for the EAD or GC to get him a social security card.

If there is at least 2 weeks left until his I-94 expires, then he can go ahead and apply for his SSN. http://www.visajourney.com/content/ssn
