Check out the links in the bottom portion of the DCF Guide. I won't swear that the links are still up to date, but those are the three sources that describe domicile best & you should be able to find the current pages if the links are old (let me know if they are).

There is also mention of domicile in the form instructions posted at uscis.gov including specifics about maintaining those ties.

Hi Guys:

Ok, as promised, here is my DCF filing exp at Delhi.

ON oct 19th, thursday, we went there in morning and reached embassy at arnd 8:15 morning. There was separate Q for USCIS related work such as I-130, no one was there in Q at that time. We were scanned two times and after submitting all electronics stuff, we were taken inside rightaway and asked to be seated after we told them that we are here for I-130 filing (you have to tell this to all guards/person so they know). One guard came in and escorted us to back side of building where they have small portion for USCIS. We were asked to seat and wait, after guard took our name and also asked what r u here for and we said filing I-130.

WE waited there, window open arnd 10 AM and indian lady was there at window. There was two peple ahead of us so we were called at arnd 10:20 at window.

She asked me r u here for your wife I-30 filing and I said yes than she asked me when you arrived in India and I said one year back. She looked at my passpost and looked for the arrival stamp to make sure. Than she asked my paprework. I prepared one big set with I-130, G325A and all other supported forms in order. She browsed through whole set as everything was prepared nicely in order by me so she dint have anything to ask me I guess except wedding pics. She asked for wedding pics, I gave her abt 20 loose pics and she picked up abt 4-5 of them and returned rest to me and than asked me to pay 190 $ fee and told us that we would receive packet 3 in a month time. That's it...no more Qs asked. She didnot asked a single thing to my wife who is beneficiary. Guard took us back to main building where cashier was sitting and we paid equi ruppes and got the receipt of that.

Here is some useful things and observation based on my exp:

- FOr filing DCF, you dont need to rush at 7 Am in morning. If you can reach arnd 8-8:30 than that' fine as but try to reach by 8:30 or 8:45 am

- As a resi proof in india, she didnot ask me fro FFRO regi permit, tax, utility, rent etc...I have been living here for more than a year. All she did is looked at my passport for entry and casually asked me are you working here and I said I was doing consulting work. Tha't it.

- If yours is hindu marraige, they may be interested in retaining/seeing pics of fire etc in wedding pics. So make sure to bring that if possible.

- u can either pay 190 $ in USD or in rupee. The rupee charge is 9120 as they have fixed this thing.

That's all. Now we will wait for packet 3. let me know if anyone has any Question.

Great job! Nothing to it, eh?

Now you've got a month to prepare for the Packet 3 docs. If you start now, you may have everything ready when you get the packet and you can get 'in line' for the interview all the faster.

i dont think you have to wait for packet 3

all they will do is mail the forms to you

aslo im curious that they didnt ask about any bills or frro or anything. can i ask if you are of indian origin? do you have us green card or us passport?

this is interesting........and hopefully good news for all of us

I am USC having US passport...I believe most ppl filing DCF are USCs. But yes I am of Indian origin currently having PIO card. I took everything with me to show them but they didnot ask for any bills, PIO copy, FFRO etc....all she did, as I said, is to look at arrival stamp on my passport.

Overall it was a good experience......and let's hope you will have same.........

im applying on monday (i hope)

i went to the FRRO today and they sent me to another office. my visa has to be changed from tourist to X visa. I was a bit nervous that i was going to be wasting time.

we walked into this office (ministry of home affairs) and i listened for 3 hours at the counselor yell at everyone that walked up there. So i was a little nervous when it was my turn. But funny thing - he said - your married to india. ok. pick up your letter to change your visa at 5 pm. I just about peeed in my pants!

still have to go to frro tomorrow - but dont think it will be issue.

raj - did you also knwo that the delhi office has been pushed to clear thier interview schedules? you should check out the delhi website and see thier news on thier front page about expediting your interview date. Maybe the date they give you will be pretty soon anyways, but if not you can always follow thier instructions on thier website to get an earilier date. from what it looks like getting a date within 1 or 2 months even is possible! wahoo. i would love to take my baby home for christmas!

also - is the PIO card worth it? since im married to PIO im eligible for this card too.

Good luck with your filing. I would say dont go without FFRO permit as they may ask you...

Actually my wife is from mumbai so our case will b forwarded to mumbai and we will get Pack-3 etc from mumbai. As far as expediting interview, I am not sure abt mumbai..even on delhi website, I guess they are talking abt expediting non-imm visa interview date not IV visa...but if you hav read on their site abt expditing NV visa, send me the linl...as I m curious to know....

Im definetly waiting for the FRRO permit

Did yours take long? i thought it would be a 1 day thing......but they made me change the visa. they coming to the house tomorrow to confirm i live here. i assumed this would be done sooner, but now im assuming/hoping by end of week.

anyways - the appointment schedules doesnt say its only for non imm visas. it only says visa appointments in general. so why wouldnt it apply to all applciations? http://mumbai.usconsulate.gov/pr102706a.html this is mumbais notice.

i hope its for all visas. i want mine to go as quick as possible. my mom will kill me if im not home for christmas. and i dont want to go if he has to stay too long......i dont wnat to be separated for very long

For all those still following this topic i wanted to post here (posted in another topic also).

I just filed my I 130 at Delhi. The rule is more strict for the 90 days than the FRRO. In fact - the FRRO would not let me register with a tourist visa, said i had to change to X visa. SInce this would take so long....i called the embassy and got to speak to someone. they said i qualified since i have been here for longer than 90 days.

FUnny thing is that when we got the embassy - even the security guards ask you - do you have FRRO? I said no, but i already spoke with (name of guy i spoke to) and he said i could apply. THen after getting the back room (CIS area) the lady came out 2 times and reminded everyone they need this FRRO.

When i got to the window i told her i idnt have it but i spoke with so and so and they said i qualifed. She said yes, you have been here more than 90 days (she was looking at my papers).

so ---- to those of you trying this the length of time is more important than anything else. I had no FRRO certificate. ANd all my bills i put in the packet, she just gave them back to me. she gave me back my 2nd copy of the packet i made as well.

SInce i was last in line i got to watch about 6 other couples. Many did not have FRRO. Many were here less than 90 days. Everyone less than 90 days was sent packing.
