Hi everybody, i'm a new member and this is my first post although i have read this forum since previous year. My pd id 28 Apr. 2011. My question is, my spouse has been living and working since 2010 and she makes money about 12500 a year. So she can't be my sponoer by herself and we need a co-sponsor but it's very tough to find a co-sponsor. Can we put money in my wife's bank account in Compensation? If yes how much money do we need? Or is a co-sponsor the only way? And the last question. When my wife got an employment verification letter from her manager her annual salary is writen 17000$ but on her 2011 tax return form is 12500$ ! The question is which one is considered for NVC and what is the diffrence ? My wife is believing 12500$ is her net annual income.

Thank you all in advance

You need a co-sponsor.

Your wife would need 3X the difference between her income and 125% of the poverty line. For a household count of 2, 125% of the poverty level is $18,912. Your wife would need ($18,912 - $12,500) x 3 = approximately $19,500 in the bank. However, it is not that simple. The immigration folks will want to know how she acquire the money. She will need to show documents that is is not a disguised loan.

You cannot simply put money into your wife's account to trick the immigration folks. How did your wife who makes $12,500 a year have almost $20,000 in her bank account? The immigration folks will assume it is a temporary loan to meet the financial requirement. If they believe your wife is trying to trick them into thinking it is her money, they can label it as fraud. This is a lifetime ban as it is a material misrepresentation.

If your wife worked the full year for her employer and earned $12,500, how did her manager come to the conclusion her salary is $17,000???? The US government is going to go by her tax return (official), rather than a letter claiming a higher income.

first i want to thank you for your proper response.

there are some points which i want to clarify for myself.

1)i think the difference should be multiplied by 5 rather than 3 because i read the existing pdf which is related to this matter and it says "X3" is for spouse or child of a U.S. citizen not a LPR although i would get really happy if X 3 is for both of US citizens and green card holders.

2)i can send this money from my country and mention this to immigration folks, can't I? or can we sell for example car or apartment or something like this in my country and provide a selling verification and documents to immigration to show how we get this money?

3) can i put this money on my own account and translate the bank statement for immigration?

4) about the difference between her income tax return form and employment verification i have no idea actually. the only thing i know is her manager never says something untrue and we only guess this difference is due to deduction of taxes or medical insurance from her monthly salary.

thanks everybody again
