Hello everyone... I hope to find some enlightenment to clear my doubts why it happened.

Hubby & I got married on 18 April 2010 in Philippines. Hubby applied our 1st CR-1 on Aug. 2010. By December, we got the result. Denied.... They said his birth certificate was fake. Though he was born and raised in NJ, USA. So we applied again after a few months. We decided to apply CR-1 visa again by Feb. 2011. End of Sep. 2011, my husband received a phone call saying that my interview will take place in a month or two. Just got upset coz 2011 ends without receiving any phone call. My husband received a phone call 1st week of March 2012 (gosh, it took a year to find out the result) saying that our CR-1 visa was denied again coz we are married less than 2 years.

And now we are planning to hire an immigration lawyer to process my papers. Just to make sure that everything will be handled accordingly.

Seeking for an advice for any VJ'ers who had experienced the same OR any opinion with our case why it was denied is highly appreciated. And any idea how much it will cost to take a lawyer?

Something doesn't seem right here.......is he or has he asked for funds for processing the paperwork? I'm hoping he is legit. Sorry for asking such a question but there are scammers.

If you married out of the country. Which means he has a passport. U need your original birth certificate to get a passport. So that fake birth certificate sounds fishy to me. Just sayin!

Exactly my thought. Plus, the calls portion of the story sound.... unreal.

Just to chime in here, it sounds like your husband(Petitioner) is pulling a fast one for whatever reason. Like others have said, it doesn't sound right.

seems like your husband is playing games with u :bonk: anyways if he really file a petition you should get a receipt # kinda similar to this #WAC0000000000

ask him to give you that receipt #. go on USCIS web and check your case. MABUHAY!!!!

yup... we got married in philippines and i have seen his original BC, and have a copy of it also :)

Phone calls to give you an interview date?

ya, that was for the petitioner, to show up at a local USCIS office.

IMO, the appointment letter was sent out, and he never received it or he didn't pay attention to it.

it's rare, but uscitizen petitioner interviews at a local uscis office do occur between NOA-1 and NOA-2 on the I-130.

So, if he was supposed to go, and didn't go - eventually the case will be denied at USCIS National office. There's a lot of casefile travel to worry about - CSC to Local to CSC again (for example).

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

The USCitizen Petitioner, the husband, has done nothing.

He's not filed any I-130..
