Hello again dear VJ members. I need your help.

Im a US citizen. In 2008 I married my now ex-wife in USA (then she was on H2B) and filed I 130 petition for her and the petition was approved. We got divorced last year.

Now I am about to file a K1 (I 129F) petition for my fiancée. My question is do I need to apply for a waiver ??? I am really confused as I have petitioned my ex-wife (not using the K1 we applied here in the USA) and now K1 petition and the IMBRA says that the IMBRA limitations apply only for K1. So shall I request a waiver as I am about to file our documents tomorrow???

In short in 2008 approved I 130 and in 2012 filing for K1.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Just be well prepared i was also married before and filed a i 130 for my ex husband and remarried with my SO and we were denied because of that the consul told me that i was married for immigration purposes just make sure u guys go prepared because to them that is a red flag and now i have to wait for my case to be sent back to USCIS and appeal but just do ur research and u should be fine......
