How do you qualify to Expedite Case?

Timeline

I was just going to see that I'd recommend looking through some recent timelines from London.

Even though Montreal is towards the slower end of the consulates, I know we'll be waiting 2-4 months JUST to get an interview after sending back packet three. Actually, the USCIS petition approval for us Montreal kids will be the quickest part of the process (hopefully). I hope that's not the case in London and it moves a little faster.

I'm not sure these days what the typical timeframe is for interviews after Packet 3 is returned to London.

The waiting time for an interview in London is 4-12 weeks, 8 is average, but that is just an average!

There are people on here who have had the interview in a week!

We do have a backup plan, we have the "church wedding" but not a legal wedding, our priest has already looked into that. I just need to get in the county! Then come back to uk and have the lega wedding once I have the Visa.

Its a long story about why we planned the wedding in advance, which I have already posted, I know the rules " dont plan ANYTHING till you have the visa etc etc" but we didnt need a Visa when we stated the planning. So no need for a telling off from anyone! (again!)

Late last summer, we were 3 months from NOA2 to interview date. I don't think things are much improved now.

Wow 3 months! Eeek1 Oh well, it will be what it will be, I guess I make sure I take proof I will be returning to the UK! When they scan your passport can they see you have a fiance Visa?

I've seen 3 types of cases here on VJ that have been successful with an expedite.

type 1) Several military deployment expedites (at each stage USCIS/NVC/Consulate)

type 2) Medical (I know of 1 at the consulate)

type 3) Age out child issue (recently at the Manila consulate)

They are granted for the right reasons. If you have to search for a reason, you probably don't have one that will qualify.

05/02/2007 Driver's License - Passed Road Test!

05/27/2008 Lifting of Conditions sent (TSC > VSC)

It's kinda like taking a handicapped parking spot just because you sprained your pinky finger.

Save the expedition for someone that could really use it.

i would never dream of making up a reason! Ever! And I never EVER park in a handicapped parking spot! LOL.

It was just a question, if you if dont aks you dont get right? i dont know all the rules and reulations. If this process was really fair then we wouldnt be having people having aprovals from August and September with people still waiting form April! Not that I am not pleased for them, I really am, but why dont they just do it in order, then us who applied before the mess up would know exaclty when we were next, intead of it feeling like a lotter!

really, I've been on here since May & haven't seen that in London! It's been about 2 months from NOA2 - interview lately. I highly doubt it.

Let's start with this - if someone were to come to you with a reason why their case should be expedited, for what reasons would you say 'I agree - I'll notify the SC to hold my case back while they process yours'?

Once you've got that list, consider how widely applicable those reasons might be and consider what the effect might be if everyone who could use them did.

As for calling and hassling - did you join the 'no call' list or do you anxiously await calls so that you can buy or donate? Most people get defensive when hassled, and would like to give back one way or another.

So I was wondering if anyone knows how you do qualify, and if you do hwo dotyou go about trying to get this done! Do you write, call, anything?

Also, does calling and hassling people the USCIS help or hinder? Any evidence?

I've just come through London and it took approximately 8 weeks from NOA2 to interview. Our NOA1 was dated April.

I'm all for being positive hon but there is a little thing called "realistic" too. :)

Hello,

That is called premium processing available for work visas. You pay extra 1000 dollars to get the decision in 15 days time

I'm sure you're aware of how careful you have to be not to invalidate your K1 by being married when you try to enter on it....

Be careful, and smart with your research. It would be dreadful to have to sit and wait out a K3 on top of the K1 for the sake of not moving the wedding.

You have the ceremony but don't sign the legal paperwork. Doable, but tricky.

I think there are two ways to use the word expedite here. Officially it refers to the request to expedite the case based on very narrow circumstances that give people a jump in the line to receive a quicker approval. Lke other posters have said, this is very difficult to obtain.

BUT there are other ways to expedite the case (or to use a better word - get USCIS back on track with your case). Looking at your timeline, you are or soon will be past the 60 day timeframe that USCIS gives itself to respond to the RFE right? Oct 11 will mark the 2 month mark since you returned the RFE (I assume it was IMBRA?) if i understood yoru timeline. Contacting your Congressional reps office to look in this is quite reasonable. There are rules USCIS operates under that allow you to seek an answer.

Having not gone through this myself, I am afraid my answer is a little vague. Someone else here (AndyMisiu) wrote a letter at the request of the VSC because he was also outside this 60 day processing case. He recently got his approval. There are some threads here that show his letter and the specifics of his case- of course you might want to avoide the postings that are more drama than of actual help. Hope you hear something soon! We are rooting for you!
