Im filing an I-130 petition for an alien relative. My husband is Canadian im American, should I send in the I-485 form at the same time? We both live in Canada now.

No. the I-485 has nothing to do with your situation.

You send in the I-130 for a CR or IR-1 visa. After it is approved your case will go to the national visa center (NVC) there you will send them the Affidavit of support and all the evidence that goes with it and pay the fee. Then you will pay the immigrant visa fee and send in the supporting documents for that. Once all that is done, NVC will send you an email for your husbands interview appointment in Montreal. Then your husband will have a medical exam in either Vancouver, Toronto or Montreal and take the results with him to the interview. If all checks out, he will get either a CR or IR-1 visa in his passport.

The whole process takes 9-12 months.

Good luck!

We are both in Ontario Canada, have been married for 8 1/2 years, can we go live in the states once the I-130 is approved? Im a U.S. Citizen with permanent residency in Canada, He is a Canadian Citizen. Whats the difference between CR and IR-1 visa? So we dont have to fill out a I-485 for permanent residency? OMG this is stressful!!

The difference between CR-1 and IR-1 is that IR-1 is for those married over 2 years, and leads to a ten year greencard.

No 485 needed- check out http://www.visajourney.com/content/i130guide1 for the forms and documenbtation you need, You can move anytime, he can only move once he has the visa (takes 10+ month).
