question about fiancee child

Don't know if this question ever been asked in the K-1 form? But i have already filed for my fiancee and her daughter just waiting the NOA 2 but my question is how can or can i give my new daughter my last name? Do i have to wait till we do all the AOS? I know my fiancee gets my last name when we marry but i also want my new daughter to have my last name too. Any help/info on this will be greatly be appreciated. :thumbs:

Adoption or a change of name by a court proceeding (according to your state's laws) is the legal means to give your fiancee's daughter your last name. The AOS docs have to reflect K2's legal last name -- you can not change the child's last name by AOS.

NVC [*] 14 May 2012 - Petition received by NVC ; [*] 16 May 2012 - Petition left NVC.

EMBASSY [*] 18 May 2012 - Petition arrived at the US Embassy in Bucharest; [*] 22 May 2012 - Package 3 received; [*] 24 May 2012 - Package sent to the consulate, interview date set; [*] 14 June 2012 - Interview date, approved.

[*] 15 May 2013 - Moved from MN to LA; [*] 17 May 2013 - Applied for a new SS card/filed an AR-11 online (unsuccessfully), therefore called and spoke to a Tier 2 and changed the address; [*] 22 May 2013 - Address updated on My Case Status (finally can see the case numbers online); [*] 28 May 2013 - Letter received in the mail confirming the change of address; [*] 31 July 2013 - Went to Romania; [*] 12 September 2013 - returned to the US using the AP, POE Houston, everything went smoothly; [*] 20 September 2013 - Spoke to a Tier2 and put in a service request; [*] 23 September 2013 - Got "Possible Interview Waiver" letter (originally sent on August, 29th to my old address, returned and re-routed to my current address); [*] 1 October 2013 - Started a new job.

As for her father if you can call him one has not been in her life since she was one! No contact No support No nothing and she almost eight now. probably a good thing because he tried to kill her mother my fiancee once and you never know what could happen to the child. But she's getting a great dad now that's for damn sure! You don't need anything from the father if he's not around in the Philippines from what i heard?

Got another question about my fiancee child i filed the I-129F and listed the daughter on it like it asked me too, was i suppose to fill out any other forms or just wait till they send the NOA2? It never said anything on the form about filling out other paper work so haven't, I know i will pay for the medical and visa fee for her just like i will for her mother but what else?Thanks

what you heard does not matter. The LAW matters. Adoption is not an immigration issue it is an issue covered by laws of states and of the PIs. Check the LAWS necessary for her to be adopted. In most countries a mere absence by the father is not enough. It MAY be enough for the mother to get a COURT ORDER of sole custody and THEN she could give permission for you to adopt. But just because the father is AWOL does not give you access to adopt his children. PI has some slightly different laws in this matter, so check the LAW. It is all available for review and reading.

Then check the LAW in your state as for adoption processes. Adoption and immigration are not related and not handled by the same authorities.

Nothing more needed until the interview when they will also fill out applications, get a medical, pay the fees, etc. What you filed was a petition, not an application. The petition is a request to allow each person listed on the petition to apply for a visa. If the petition is approved each person can apply for a visa. On any notifications regarding the petition the only name listed will be the primary beneficairy, your fiancee. NO ONE else can get any benefits without her anyway. All other benefits are derivitive of hers.

That is what I was hoping to here! So i can do all the papers for both now while i'm waiting on the NOA2 and when we get the NOA2 send My fiancee and daughter to get their medical and pay for the visa. Dose the daughter need to be at the interview too? Thank again for the info.
