Type of Visa for Fiance/Spouse of US citizen - I live in India and I am engaged to a US Citizen. We would like to know which type of visa we need to apply for me to go to the US at the earliest. Can I apply as a Fiance or wait for us to get married so that i can apply as a spouse. Which type of Visa will be less hassle. Also, which is better, getting married in the US or in India?

If you're looking at a fiance visa, it'll be K1. Personally, unless you have a strong case, K1 could get denied.

Spouse visa will be the IR1/CR1. Where you get married does not really matter. How good a case you put together is what matters. If you're getting married in India, the US citizen will have to obtain a no objection certificate from the US consulate before you can get married. Also, keep in mind that there's a waiting period of 30 days from the date of registration before the marriage can take place. There's nothing like getting to the US at the earliest. It will take anywhere from 9 months to a year before you eventually get to the US.

The OP never specified that his relationship was an inter-religious one, only that she was a US citizen.

The 30 day waiting period is only applicable when marrying via the Special Marriage Act. If they both are Hindu, they do not have to wait 30 days and can marry via the Hindu Marriage Act.

The 30 day waiting period is only applicable when marrying via the Special Marriage Act. If they both are Hindu, they do not have to wait 30 days and can marry via the Hindu Marriage Act.

Neither the fiance or spousal visa are quick.

** Just from my own experiences, my friends actually- they are Indian, they preferred to be married in India. They have huge ceremonies and invite hundreds of people (one of my friend's families spent over $100,000) as a part of their culture and that is something they could not have done if they persued the k1 visa.

I do not know if that is what you do where you are from but that might count for something. Typically people coming to the US on K1 have smaller weddings because you do not know when you will be approved and then you want to be with your partner straight away and it is not feasible to have everyone of your friends and family travel within 90 days to meet you in the US for your wedding.

That is not to say you cannot have an official ceremony here and another in India if that is what you choose, but you will be getting married "officially" in America.
