Hi everyone,

I am gathering my documentation for Packet 3 and I am not sure what to do with the Packet 3 checklist that we have to send by telling them we've already gathered the required docs. Example:

____ The appt letter showing the date of interview ( I don't have yet till they send P4, right? Do I checkmark it or not?

_____ Adoption decree (not my case)

_____Court records (not my case)

_____ For K visa applicants, a letter of intent to marry signed by the petitioner within 30 days of interview date.. ( my fiance will send it to me once we know when the interview is) ..

My question is: For those docs that don't apply to me do I leave them blank? or put N/A ?

For the letter of intent and appt letter what do I write about?

I didn't even check off anything, I just signed it. However, you're safe just putting N/A where it doesn't apply to you (adoption decree, court records). Even if you do not currently have a document but you're bringing it to the interview you check it off (appointment letter, letter of intent). It's basically just to determine that you understand what you have to bring with you on the day of the interview, not what you have currently.

If your fiance currently resides in the USA you DO NOT have to provide evidence of domicile. That is only for US citizens who are living in foreign countries. If he lives in the US, huzzah! Ones less thing to worry about.

If he does not currently live in the USA I recommend you check out the Proving Evidence of Domicile thread pinned at the top of the forum. Montreal is notorious for being hard about evidence of domicile.

Also, I don't know if I've already told this in PM already, but it bears repeating: On one of the forms for packet 3 it says to include things like your birth certificate, police certificate, I-134 etc. but you DO NOT mail these off with the packet 3 forms- instead, you bring them with you on the day of the interview. Packet 3 only includes the forms, 2 photos, and a photocopy of the biographic info page of your passport.

Pocheros, I know what you mean, and "yes" you have told me that before and I really appreciate you telling me again.

The difference docs I am putting together with my pck 3, is :

- photocopy of my Work Permit

- Photocopy of a summary of my bank account (proof of address)

- Photocopy of my drivers license, health card

- Photocopy of my taxes return 2010 and 2011

I decided to add ALL these papers along with the form, because I read on Canada Wiki that, foreign HAS to prove their legal status in Canada, so I am sending now before they ask me. Do you think I should be ok?

I better have a lot of info than missing information. I just dont wanna wait till they ask for, cause it says on the site.

I am not sure what Montreal specifically would want to see for proof of legal status (is there a permanent resident card? or are you a non-PR with legal status? I have no idea how that works) but there is no harm in sending it along with your packet 3. Since your case is a bit different from most people's it might be useful, and if the consular officer who opens it doesn't like it they can just put the photocopies in the paper shredder, lol. And of course bring extra photocopies to the interview :) The documents you listed certainly seem like good evidence to me but I haven't read about someone having to prove their legal status before so I am not sure.

Sending the info before hand is a good idea because you could get an RFE asking for it in case they pre-screen you since you are in Canada on a work permit and they need the proof to interview you.

I would also just in case bring the proof with another set of copys of it with you when you go to the interview.

Its required to prove it or the US embassy in Canada will not interview you. This is to stop people from entering Canada as a visitor and applying for a visa to the USA. They require proof of legal residency ( work permit, PR card and status, Student visa etc) that is valid for 6 months at the time of interview (ie if your papers are about to expire in 1 month they will not interview you until you renew your status )

Thank you so much for your feedback on my doubts. I called DOS today, they received my petition (which is great) but P3 hasnt been sent yet. So I also asked about sending proof of legal residency along with P3 forms, the visa analyst said i should be ok sending them all together in my P3.. Just confirmed with what you said. Guys,

I called DOS today ans they said my petition is at Montreal Embassy now and I should wait for National Visa notification.

Is now 100% sure that I can send my P3 or should I wait for a few more days and send it? My P3 is already prepared, all done, just waiting to be mailed.

Did they say packet 3 has been logged? I would ask them that specifically. I wouldn't send off packet 3 until you're absolutely sure Pkt3 has been logged because they might be a little slower due to verifying your residency status.

Hi Pocheros,

No, they didnt say it was logged, just said that my petition is at the consulate already. I asked if my P3 has been sent, she visa specialist said "NO".

To be honest, because I am not resident, I have this little insecurity inside of me about sending my P3 without hearing the word "yes, we sent your P3".

So, I guess I will wait for a few more days and call them again.

What does "logged" really mean? what they do with our petition at this point? What is the difference between, your petition is at Montreal Embassy and DOS? It doesnt mean the same thing, right? I would love to understand those department a bit better.
