:help: I am Canadian IR-1 case. My husband just submitted the I-864. If I can cross the border to stay with him. Could I continue my application inside of US? OR could I do medical check in US and get interview in Montreal? I hate the sepated life. Please help us.

Thank you so much and have a good day!

if you are a Candian Citizen by law you can stay up2 six months in the US.. but while your petition is in process travel depends if the CBP officer allows you to go through, you might need to show your ties to canada like yr job letter, mortgage, loan etc

I think you want to know about a TN visa it is a work visa by an US employer i believe it falls under NAFTA for which one has to qualify..

Thanks

:P thank you for the reply. Actually, I have got a offer from a company which locates in the same city as my husband's. What I am thinking is if the application of TN visa is allowed during the IR-1 visa application process???

whts yr status on the IR 1 now if you can get a TN visa you can work legally in the US and can be with yr spouse, when yr interview comes up you will have to travel back to yr country for the same.. i dont see a issue here

:P Thank you so much pri. My husband just submitted the I-864. So we are thinking that with TN visa, we can stay together while waiting for the interview. Are you pretty sure that I am avaliable to apply for TN visa currently? Because I know TN visa is kind of non-immigration visa. And I am worried if any non-immigration visa is not allowed to be got during the application processing of immigration visa?

Have a good weekend!! :star:

Filed: IR-1/CR-1 Visa Country: Canada
Timeline

I belive that was asked awhile ago on this forum--TN visa while going through a cr-1, can't recall the outcome of it, Maybe do some searching on the http://uscis.gov/graphics/index.htm ON VJ mostly deal with the k1,k3 cr-1/ir-1 situations. If you do a search on VJ you might find some info. Best of luck

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied, that is if ur polite and didn't lie! Refer to #1
