ok, finally got a co-sponser, hubby confirmed today that his auntie is gonna do it for us :) so this is good :) now my question is... she has a son who is grown and in college in FL.. and i think a daughter.who is also grown.. in order to NOT get RFE or if you even do I'm not sure, does she still have to put down their info on the I-864 form or whatever one it is (I dont have it in front of me) I know you have to put down children living with you and that you claim on taxes, but how does it work then they are grown adults and they have own jobs etc?

only kids under 21 are counted in i 864.....

Incorrect answer above, only those she has filed as dependents on her taxes are listed on the 864. Their age doesn't matter, if she is still supporting her son who is in college he will be listed as a dependent.

ok so ONLY if she claims them on her taxes? i know that she doesnt because he works and supports himself and is in college. Thanks :)

Read the instructions for counting household members on the I-864.

From the I-864 instructions;

21d - Enter the number of unmarried children you have who are under age 21, even if you do not have legal custody of these children. You may exclude any unmarried children under 21, if these children have reached majority under the law of their place of domicile and you do not claim them as dependents on your income tax returns.

21e - Enter the number of any other dependents. You must include each and every person whom you have claimed as a dependent on your most recent Federal income tax return, even if that person is not related to you. Even if you are not legally obligated to support that person, you must include the person if in fact you did support that person and claimed the person as a dependent.

thanks aaron..thats what I thought, but I wanted to make sure since I was talking to hubby about it. Sometimes I get confused with the whole paper work thing. lol. thank you! :)
