So I got an RFE for my adjustment of status.

It asks for more evidence for the i-484 document. Initially, my wife and I signed the form, attached her tax records (she earns well over the thresholds) and included it in the pack.

Were we supposed to contain a cover letter for this document? If so, what should it say? Is there an example that we could base this on? I couldn't find any information in the guides section.

Many thanks as always for your support and guidance.

F.

What does the RFE ask for specifically? You need to include what they ask for and without knowing that we cannot really give you any meaningful advice. Maybe if you tell us what the RFE says we can be of more help.

Until then it is just a guess on our part. My guess is that you need to fill out form I-864 and include all evidence listied like tax transcripts, letter from her employer and such to show that she indeed does make more than the 125% above the poverty level and is willing to repay the US government should you get any mean tested benefits before working 40 quarters, or becoming a USC, or dying, or if she dies (this is what the I-864 for is for), but this is just a guess.

Thanks Dave, it says:

"The Petitioner is to submit the following:

AFFIDAVIT OF SUPPORT - FORM I-864: In Conjunction with the I-864 on file you are to submit copies from the Internal Revenue Service, Taz Transcripts for 2010 and 2011 if available.

(Do not submit duplicate copies of the I-864 or 1040's)

If te petitioner has not filed taxes she is to submit a copy of his W-2"

Apologies, I used the wrong code on a previous post for this.

I received the following request for further evidence. Initially, my wife and I had included tax returns with the completed form. But then we got this today, and we are completely confused.

Any ideas?

You need to go here and order tax transcripts for the requested year. It should take about one week for them to arrive. Get the transcripts for 2009, 2010 amd 2011 if you have filed this year. Otherwise wait unitl after you file and request 2011 to take to the interview, if you have one. They do want copies of this years, 2011, W-2s if you have not filed taxes for 2011. So I would give them what they want which is a tax transcript for 2010, 2011 if you have filed or copies of the W-2s for this year. This would be a good time to file your 2011 taxes. (I would still ask for 2009 transcripts and take that to an interview should you have one)

Good luck,

Dave

go onto www.irs.gov and order 2010 tax transcripts

They are also asking for 2011--so I guess you should file the taxes or if you already filed them then just order 2011 tax transcripts also and send them in

I heard it takes about 3 weeks to be able to have tax transcripts available after you file taxes so if you have not filed 2011 yet then hurry so you can respond to the RFE in time

Or Just send in the copy of the W2 for 2011

I think they are questoning if our income is enough to fill out AOS

Yes, my guess is that the tax returns you sent were not complete. The tax transcripts will solve the problem.
