Who completes I-864?

We are currently filling our paperwork, to get ready to send it to USCIS.

My husband (U.S. citizen) does not meet the poverty line. His parents do, and they want to file as sponsors. Does my husband need to file the I-864 with them, or just his parents file the form and additional documents?

The petitioner is required to complete an 864 form and submit evidence regardless of having a co or joint sponsor. If he does not complete the form with evidence you will get an RFE and a delayed petition.

Does he also need to include his tax forms? What if he has only one (of this year)?

Your husband will need to complete an I-864 and either supply his tax returns or explain that he didn't need to file taxes. His parent will fill out an I-864 also, and the parent's spouse will complete an I-864A, and they will submit all the required evidence.

In I-864 form there is a box that says:

I'm the only joint sponsor

and there is a box

I'm the firs or second sponsor.

Does my father-in-law check the box of first sponsor, and than his wife the second sponsor?

Father-in-law is the only joint sponsor. His wife completes the I-864A and her income will be listed on her husband's I-864 in question 24.

The first/second joint sponsor is only an option for when more than one person is immigrating on the same visa.
