Hi All,

I am really frustrate by all those steps and worrying about it all, please help me as below:-

I (Indian) and my fiance is US Citizen, she had filed I-129F on June 16 2011 from US. I had my interview in Delhi Embassy on Feb 23rd 2012. CO was very rude and he was not even looking at me. Not listening and asking question very fast and asked me simply two question as below:-

1. How did you meet her.

2. What really attract you about her.

Right after that he issued me two papers, one was 221G white slip and another was english translation of birth certificate. I had submitted everything to them on the same day of interview. I waited for a week and start sending emails to VFS // USCIS and congressman about it because i had no idea what was going on. One congressman replied us on March 12 2012 saying that she will send Inquiry to Embassy about it and she emailed us back on March 15 2012, saying that Embassy have denied the visa and sending back to NVC soon and then USCIS back. It also says that on behalf of my interview, i couldn't present evidence to show our relationship even he didn't for anything.

We explained congressman that it is not fair because officer was rude and how come he decided about our relationship in 2 minute ? He didn't look up any papers and he was so rude, congressman understood and saying that we have to wait till the case goes to US back. Then she will help us again to file the complaint for the same.

Please please help us, i am really frustrate and have no idea what to do. Please give us your suggestion about what to do, even in 221G whatever the paper they ask. I had submitted all that before interview coz i knew all that by reading on Visa Journey. Still nothing worked so far, please help us.

Greetings, I feel compel to respond to this. First of all, I think you did the right steps by contacting the congress. Secondly, I am somewhat nervous because my fiance' is from india, and I am u.s. Citizen. We met in iraq, and I became pregnant. However.. I am 16 years older. I saw on VJ, that they look at age difference. When I submitted my I 29, I did not enclose any proof. So... I am so nervous. I had my baby Feb. 21. I will send the birth certificate showing his last name, which is Singh. Depending on the interviewer, I heard that they dont like india to marry americans. Love is love. I will keep you in my prayers. Good luck. Which embassy did you go to? Thank you.... Keep the faith..

This is not true. What consulate officers do not like is fraudulent marriages for the purpose of immigration benefits.Lack of preparation could be a reason for so many denials coming out of Delhi.

You say you did not submit any evidence with your I-129F. What do you mean by this? Did you submit only the minimum requirements and nothing else or did you only send the forms? One of the requirements of an I-129F petition for a K-1 is evidence of meeting within the last 2 years. One usually shows this by attaching boarding passes or passport stamps showing the dates. Did you attach any of this? If not, you will most likely be getting an RFE (if lucky) or your petition will be denied and you will have to re-file.

Could you provide more details about the relationship with your fiancee? Do you two have a large age difference? Did you meet online? Have you two spent a significant amount of time together in person?

I don't mean to pry, I'm only trying to see the big picture here. If your case has any of these "red flags" you need to trump them with evidence that will convince the CO undoubtedly that you two have a bonafide relationship. It seems that the evidence you presented was not enough to convince the CO. Did your fiancee attend the interview with you? US citizen petitioners are allowed in the Delhi consulate.

Contacting your congressman can be helpful to some degree but remember that a congressman cannot overturn a CO's decision. What you need to find out is what exactly is written on your denial so you can overcome that the next time around. What may happen next is that your fiancee may receive a NOIR/NOID. She needs to be very prepared to respond to that if your service center decides to take action on that.

Hello Mr. Singh,

Honestly, that officer was very rude and doing that all in very hurry. Infact my interview took around a minute only and it seems that he was sitting there only to give me while slip.

We met online more than 3 years ago, we have so so many emails which i sent to them. So many phone calls bill of around 1.5 years and i highlighted all phone number using an marker on every single page. Sent all original card my fiance sent me from there to India, they are around 5-6, i sent around 75 photograph we took when she came here last year in Feb 2011. Even before interview after reading so much on this site, i also submitted mine and my fiance statement along with mine & her parents statement (Notarized by bank in US). Sent her US passport copy, her birth certificate and work papers. Infact everything they ask for, we had sent in advance and again submitted once they issued me 221G in Interview. I am 23 years old and she is 25 years old. She is working there as cook and i used to work as a travel agent in new delhi. Honestly, i am not sure what's wrong and why did they issue.

As per me, i really feel that it was all happened coz of my interview. Yes, i was nervious and not giving answer very well. It might seems him bad or not sure. Just have no idea what to do.

You should be fine. A sizable age difference hurts a couple because that isn't the norm (female>male) but also because with so many years separating you guys, it usually means the woman is experiencing menopause or is at a point in her life were she doesn't want to have anymore children with your new husband . These things to Indians are a big no no and so this is the standard to which you are held. Luckily for you you didn't meet on any 'website' and share a child together. Persons committing marriage fraud (even if 1 party doesn't know the other's intent) will not go through the hassle of having kids because they tend to want a clean cut when they get what they want and leave (prospects of child support/simply having children with the partner they're using simply isn't worth it).

Since you have a baby, COs expect (with evidence), before your interview (if baby isn't 2 young), that your fiancée and his family gets to meet and spend quality time with his daughter/son.

This is me being nosey but what were the circumstances under which you and your fiancée met in Iraq?

You should be fine. Hello.. I was a goverment contractor. He was there for 5 years before me. I was his supervisor. He was a truck driver on base. I only found out about VJ, after I filed. However, if I do get a RFE, I have passport, department of defense contract and phone log. He hasnt told his mom because, she has his money. In fact 25k. Over the six years. She has told him that he did not follow india culture. So with that being said.... Why tell her of the baby. My son last name is Singh, and I have the birth papers. I mailed my form overseas, but when I arrived by to US, they rejected, because I had no fee. I have been waiting since nov for RFE. Who knows...

That can be the possible reason. I remember you somewhere mentioned, CO asked you, What really attract you about her? and you answered like " Even she is an american... ", Is that correct?

Call logs, chat, parent confirmation are kind of supporting documents, and it doesn't make much weight for your case. What makes different about how really you guys do know each other and how much you two have spent the time and have frequently visit to each other. That's what makes different.

Call logs, chat, parent confirmation are kind of supporting documents, and it doesn't make much weight for your case. What makes different about how really you guys do know each other and how much you two have spent the time and have frequently visit to each other. That's what makes different.

although it seems you didnt want to sound harsh - i must say to you that is how you came across by saying what you said after that line.

i am UK born - english is my first language - i have lived in the US since 1998.

Either yourself or your spouse is english i presume.

So you will know, that there is a large difference in even just the way that US english is spoken compared to UK english.

So, can you imagine the way that indian sub-continent residents speak english? and how it can be interpreted?

did you notice the replies in that post you pointed out?

It is good to give critcism - but lets give positive criticism and not negative.

These forums are here for questions/answers and support.

To the OP - give them the required info.

The next interview you have - ask for it to be in your native language - that will put you at ease im sure.

My wife is pakistani by birth - can speak english really well - english major - masters - taught it too - but i will be advising her to speak in her native language come the time of the interview. I know how easily language can be misinterpreted.

Good luck with this - keep us apprised of how it works out for you - there are people here who will provide you help and support.

Despite your current issues I think you'll be fine just keep abreast with your case.
