Hey VJers! I just stumbled upon a really old post about the ROC application. Is it true that you can only file for ROC 2 years after you've been in the States on the K-1? I'm aware you get married within 3 months of moving down on K-1, bla bla bla. But is it true that you have to be in the states for 2 years before filing?

If so, does this mean I cannot travel to Canada and visit my family for the 2 year wait? How does this work?

You have to be a legal resident of the USA for 2 years. You can apply 90 days before the expiration on the green card.

Please do the research. Use the VJ guides and the USCIS instructions and guides.

Moving this to ROC as its not a K-1 question but a ROC question.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

After you are married you file for AOS ( adjustment of status). When you file you can file for the GC ( green card), the EAD ( employment authorization) and AP ( advanced Parole) all at the same time. When received, usually in a month or two the AP allows you to travel, in your case, back to Canada. If your AOS interview is successful, you receive a GC, and the AP is no longer needed.

None of this has anything to do with ROC.

I'm aware of this, I wanted to confirm. What I was mostly wondering was the Canada question. I went to the ROC page on the USCIS website, but it doesn't say if you can travel or not

If you are aware of this then you wouldn't be asking about if you can leave the USA. As I said you have to be a LPR of the USA for 2 years, not you cannot leave america ever the end.

You also asked WHEN to file for ROC which I also explained. 90 days before the 2 year LPR expiration date on your green card.

Then also said research.
