Hi there,

I'm a British female and currently living in the US (new york) on a B-1 visa. I was granted a year long stay at point of entry, based on a voluntary job I took with an arts council here.

My job has now run it's course and my visa is due to end in 3 months time.

I recently met a couple who own a small business that is thriving, as a coffee/sandwich/artisinal grocery store and they would love to employ me as a prep-chef/sandwich maker, with my culinary experience that could re-invent the freshly prepared foods, aspect of their store. One of the owners would also like to train me as a cheesemonger. They are willing to help me out in any way that they can, visa wise.

They mentioned that if they have to take me on as an intern in terms of small business, they could and my parents are more than willing to support me, financially.

Is there a visa that would be most appropriate for this situation?

If anybody has any suggestions, that would be great!

Thanks.

Do you have an American Significant Other?

Marry and adjust, should take about 3 months to get an EAD.

So, just to clarify, as I'm confused with what I have read....am I able to get married asap, apply for adjustment of status and still be able to return to my home country for a month as soon as this current visa is up (in 3 months time) ?

As long as you have AP, the same time line as for EAD.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

Not to leave, to be able to get back in again.

To clarify; your advice is I should marry asap, apply to adjust status to permanent residency (or is it spouse visa??), apply for AP and EAD at the same time? Sorry to keep asking but I literally have no idea what could be best.

Visa's are used to enter the country you are looking to adjust status from B1 to LPR.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

Boiler is correct. Do not leave without AP or you won;t be able to get back in for several months.

Are you ready to get married and live here? You can't just marry solely for the immigration benefit.

If you choose to marry and adjust, then you probably won't make it home for this month trip you have. Do you need to go back or is that just your current plan?

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

This bears repeating. Consider the fact that you will have to prove bona fide marriage and you will have an interview.
