The CO believed you failed to provide adequate information or documents. Follow-up with USCIS. This is about all you can do for now.

Thomas is right. Definately call USCIS to find out if your petition is back with them. Then you will know better how to proceed.

Something you need to understand, a US Passport is and remains property of the United States Government, and is only issued to you for your use. They can revoke the passport at any time and require you to return it to thier possession.

I notice that you NOA2 was received in only 63 days. Obviously expedited for Haiti. It's sad that other people are waiting 6 months while these cases get the fast track.

It is true. Deliberant Fraud. And the Cousulate in Haiti is a extention of the US Immigration Services Division.

I said that the US Department of State has NO ARREST AUTHORITY, and even if they did they would have no authority or jurisdiction outside the borders of the United States

If I understand the concept of embassies correctly, any embassy is an extension of its country in another country and thus is considered safe haven for a citizen of that embassy's country(provided that the laws of the foreign country have not been violated) or in case of conflict, an extension of that country and a place to be shut down or put under surveillance at the least by the country in which the embassy exists. In other words, an embassy is a piece of a given country in another country.

In other words, an embassy is a piece of a given country in another country.

Yes, any US citizen may request safe haven under the guise of diplomatic immunity within the Embassy compound, but that doesn't mean that the host nation won't come knockin at the door or that embassy officials will grant your request. Per the earlier comment that situation is not the same thing as a Dept of State official, Marine security detail, or other consulate official placing someone under arrest within the embassy compound. If someone for example commits a murder within the embassy walls they will be turned over to the host nation for prosecution.

It's a rather murky area, and the exact rules vary from country to country depending on the bilateral terms negotiated through treaty. If you want to delve further into the details, be my guest: Vienna Convention on Diplomatic Relations

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

OMG I can't believe the OP's question turned into a confusing dispute about whether or not the embassy has a right to arrest on the spot....Her fiance was denied the visa and she is looking for help....She may not know how to write perfect English but she is trying to get some help.

Again wait for your petition to be returned to USCIS and then contact them.

All you can do is hope for the best... It does appear as if your stories did not match, hence the fraud unit reference. The US takes those cases seriously and has to investigate accordingly.....

ummm...Sounds like you and your fiancee could have benefited from reading reviews posted by others here and going over the possible interview questions. The worst that could happen is you get denied. The best thing is you can always apply again and this time BE PREPARED!
