K-3 Confusion

Hi Friends,

I am looking for some advise from people who know much more about this than I do! I am a UK citizen who married a US citizen in 2007. We married in the USA while I was on a student visa. As we were unsure where we would reside eventually I did not apply for a marriage visa.

I have been working in the UK for several months on business and am now ready to return to live permanently in the USA with my husband. Once we begin the paperwork, can I apply for a K-3 visa to be with my husband in the USA while waiting for my green card, even though we were married in the USA at not abroad??

I can't seem to find an answer anywhere!

REMAINED ON STUDENT VISA 08-11
9th July 2012: I-130 filed
16th July 2012: NOA1 received(estimate as it never actually showed up in mail!)
18th March 2013: NOA2 (252 days)
25th March: Case received at NVC
4th April 2013: Case Number assigned
9TH April 2013: NVC email received
11th April 2013: Expedite to Embassy approved

17th April 2013: Case recieved by Embassy

18th April 2013: DS-230/2001 sent direct to Embassy

30th April: Embassy 'can't locate' forms

1st May 2013: DS-230/2001 resent recorded delivery

2nd May 2013: Interview date emailed for next day!

3rd May 2013: Approved at Interview

8th May 2013: Visa Arrived

Thanks so much for your feedback!!

IR-1 definitely seems the way to go, as we were legally married in 2007 in USA (had ceremony last summer in UK however). But am I destined to be stuck in the UK while the process takes place? I can't seem to find any info on how I can get into the USA to wait with hubby.... :help:

Did you overstay in the USA after your student visa? If not, you have a reasonable chance of being able to visit your husband during the process, but cannot go to live in the USA until the IR-1 visa is granted.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

Nope I didn't outstay my visa. Stayed for 1 year after graduation which is within the allowances of the J-1 and then left.

So I can still visit using an ESTA? But just not stay for an extended period or work until marriage visa arrives?

It seems like such madness that there is a process in place to allow those marrying outside the USA to be together and work, but nothing for those marrying inside the USA!

Not sure what process you're talking about but the spouse visa process is the same regardless of where the marriage takes place.

Facts are cheap...knowing how to use them is precious...
