What name to put on I-485, G-325a

Timeline

Entered on a K1 in mid November.

Applied for and got SS card early December

Married late December.

We did not take the marriage document to SS office to change her name. Now the I-94 is expired and SS will not make any changes with out legal status from immigration. They did not specifically say but I think they mean a green card.

So the question is what name do we put on the I-485. The name that is on all the other documents (her maiden name),

or her new married name (First name, Last name, My Last name) that is not on any documents yet.

I change my maiden name into my married name. I used it in all documents for AOS.

Whatever legal name you want to have on the GC, you put on the AOS application. So if she wants First, Maiden, Married then put that on the GC. When the GC arrives go back to the SSA to have the name on the SSC changed. Just a word of caution: remember for international travel she must use her official government issued ID and the name on the travel documents must match the name on that ID. For now that ID is her home country's passport. The GC is only used to re-enter the US. SO if her passport is still in her maiden name, you must remember to alway get the travel documents in her maiden name.

This is how they explained it to us when my wife got her SS card. They also said you must do a legal name change to change your middle name.

06/01/2011- appointment date, put on administrative review

06/24/2011- visa granted

06/29/2011- received visa

07/18/2011- cfo class

07/21/2011- arrived in America

09/02/2011- happily married!

AOS Timeline

12/01/2011- AOS packet sent

12/06/2011- received email and text from USCIS with MSC number

12/07/2011- check was cashed

12/10/2011- received NOA hard copy dated 12/05/2011

12/12/2011- received NOA hard copy for biometrics appointment for 12/28/2011

12/24/2011- received NOA hard copy stating that our case was transfered to CSC on 12/20/2011

12/28/2011- biometrics appointment completed

06/25/2012- put in service request

09/12/2012- AOS approved

09/17/2012- card production

09/21/2012- greencard in hand

ROC Timeline

08/04/2014 - sent ROC packet

08/13/2014 - received I-797, NOA, dated 08/08/2014

08/28/2014 - received biometric appt. letter for 09/11/2014

02/25/2015- ROC approved

The clerk at the court house told me that changing middle name was not a problem.

We were OK to do a "legal name change: if we had to. I contacted an attorney. His fee is covered by a legal services plane I am in but the court fee and newspaper notices are about $400 and not covered. But even that would be ok if it got us to the end, but he said only US citizens can have their names changed in the US courts. The only legal document I can get for a non us citizen to show a reason for a name change to the SS office is the marriage license and it does not show the new name at all ,only the full maiden name.
