Hello VJ,

First of all, thanks everyone for helping so many people go through their tough moments and being so helpful.

Some might remember my user. I and now my wife, filed for k-1 visa and it was approved last year on July. She came the same month, and got married in September, but we sent i-485 on December(her Visa expired January 16th). She had her finger printing done December 27, and on mid January we got a letter from NVC saying they were re-allocating our documents to California for a fastest process. Since then, we have been waiting for the interview or green card. Although, it got to a time where we definitely need her to get a Social Security so can work and get a driver license etc.

I am aware that after finger printing the AoS takes anything from 2 to 8+ months and there's no way to expedite it. So my question, is there a way for her to get a SS so she can start working, driver license, school, etc ? And if so, what is the process and how long it takes.

She cannot work with just an SSN. She is require to have an EAD or green card.

She cannot get the SSN unless she has her EAD or green card.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Hmm ok thanks. We'll just have to wait then, so the 27th of march will be three month since finger print.

Did she file for EAD (I-765) at the same time as the I-485? If she had done so in December she would most likely have had her EAD by now, and with that she could get a SSN and would be eligible to work.

She can still file it for free now and will probably have it in about 2.5 months.

Waiting for 2.5 month after sending that would be pointless by now, since that will be 5+ months since Aos was sent and probably will get approve by then.

Unfortuneately you cannot work unless you get an EAD which you did not file for. You can get an SSN but it will clearly state "not valid without DHS authorization" meaning it has to accompany either an EAD or a Green card. You'll have to wait for the aos to be approved.

If I were her I would file for it anyway. It's free (include a copy of your I-485 NOA1 to have the fee waived). She could be waiting 6 months or more for her GC. I would also file for AP (I-131) at the same time.

OP had you not waited so long you could have gotten the SSN within 2 weeks of entry to the USA. Then been able to use it for bank accounts, medical insurance, drivers license etc, even to work had she applied for the EAD.
