HI:

I have i question about the law o whatever the president obama signed for citizens spouses, i have a friend she's trying to file the I -130, she had a meeting with immigration attorney and she told her she wont go to CDJ because obama new law, she is going just for 2 or 3 days to pick up the pakage, and a heard another couppples histories about the same thing diferent attorney, how are they saying is going to happpen and promise something, USCIS page already said is not activated yet, my question is those people should listened to those lawyers ?

I hope you undestand my question my english is not good, i tried my best here, thank you for your time.

New law? Huh?

Is your question: should I use money on a lawyer? (answer: probably not)

hi-

I'm not sure is a law, he signed so us citizens spouses can stay in usa during the process, and get the waiver aproved and go to the their country just to get the visa. I read at uscis page thats not aproved yet. but some lawyers are telling people is for sure and promised they wont go to their countries.

You are correct, the new wavier program has not been activated yet.

USCIS is considering changes that would allow certain immediate relatives (the spouse, children or parents of a U.S. citizen) who can demonstrate extreme hardship to a U.S. citizen spouse or parent to receive a provisional waiver of the unlawful presence bars before leaving the United States.

These procedures are not in effect and will not be available to potential applicants until USCIS publishes a final rule in the Federal Register specifying the effective date. USCIS plans to publish a notice of proposed rulemaking in the coming months and will consider all comments received as part of that process before publishing a final rule.

Do not send an application requesting a provisional waiver at this time. USCIS will reject any application requesting this new process and we will return the application package and any related fees to the applicant. USCIS cannot accept applications until a final rule is issued and the process change becomes effective.

Be aware that some unauthorized practitioners of immigration law may wrongly claim they can currently file a provisional waiver application (Form I-601) for you. These same individuals may ask you to pay them to file such forms although the process is not yet in place. Please avoid such scams. USCIS wants you to learn the facts about protecting yourself and your family against scammers by visiting uscis.gov/avoidscams.

If you already have an immigrant visa interview with the U.S. Department of State, we strongly encourage you to attend. The Department of State may cancel your immigrant visa registration if you fail to appear at this interview.

They need to fire their lawyers, because they can not read nor understand the English language.

Mi abogada me dijo que no saben si la van a poner manana o el siguiente año, y me dijo que podria esperar si queria, pero que no sabian la fecha ni tampoco creo que estan 100% seguros de que se va a implantar. No creo que los abogados deban "prometer" esto si no hay reglas sobre el asunto todavia.

Feb 8th 2012 - APPROVED!!! (197 Days or 6 1/2 months from NOA1)

Feb 21st 2012- Assign case number (13 days from approval)

March 9th 2012-Packet IV sent to NVC

March 14th 2012-NVC closed my case in 3 DAYS!!! Waiting for interview date = Nerve wrecking

Consulate

March 16th 2012-Biometrics Appointment

May 17th 2012-Interview day!!!

May 18th 2012-Will see my family again after more than 10 years...

Mi abogada me dijo que no saben si la van a poner manana o el siguiente año, y me dijo que podria esperar si queria, pero que no sabian la fecha ni tampoco creo que estan 100% seguros de que se va a implantar. No creo que los abogados deban "prometer" esto si no hay reglas sobre el asunto todavia.

Gracias mini, es lo que no entiendo cmo puede haber abogados que prometen asi por seguro eso, y la verdad me preocupa que pueda pasar a algo peor solo p;or que son imcopetentes y mentirosos. gracias por tu respuesta.
