I WAS GOING TO USE A SPONSOR BUT NOW HE'S GOING TO BE IN JAIL UP TO 20 YEARS!

Hi everyone,

I got my NOA1 on January 13 for my petition I-130 and my husband and I are now waiting on approval, but since I've been staying overseas with my spouse since May 2011, I don't have a job so no I need a co-sponsor for the NVC stage. I was going to use my brother in law because he makes 44k a year and only has two kids because my parents receive govt. assistance since my dad suffers from kidney failure. My dad has also been severely ill the past 2 months and I decided to change my flight from May 2012 to March 19 which is this Monday. I think its a good idea since my father needs me right now and I have my whole life to spend with my spouse. Now I got more terrible news last night from my sister that my brother in law is in jail because he hit her.He isn't getting out anytime soon either because he's a boxer and had other charges as well.Now I could care less about him now only about my sister's well being and my fathers but I don't know now if I have enough time before my petition is approved to go without using a sponsor. I am returning to school in August but I can still work full time. I worked as an accounting intern but only worked part time and made about $500 every 2 weeks. Do I get a second job and use my paystubs as proof that I can sponsor my husband alone or I have to get a sponsor? I don't have anyone else to use. My family is small so I have no one else to use. Please help.

You will either need to earn 125% of the poverty level on your own to meet the I-864 requirements without a Joint Sponsor. For a household count of 2 (you & your husband), 125% of the poverty level is $18,912. If you don't earn this, you will need a Joint Sponsor.

Your brother-in-law will not qualify as a Joint Sponsor if he lose his job.
