Not sure if this is the right forum, but here it goes.

My fiance will be here in 3 weeks. Obviously we have to go through the AOS and such, and she has to secure her citizenship. Her mom is a diabetic, with some medical issues that go along with her condition. Her legs have swollen, etc. I know Diana has to be a citizen before we can go through the process to get her mom here, but is it possible to request an waiver or something if a family member has a medical condition and will get better treatment here?

BTW, they live in Manila, for those that do not know me already, as I've not posted in this particular forum before.

Nope.. what was her mom doing ALL these years..? Thats no grounds for a waiver EVEN if it was ya wife. There are so many diabetics here in the USA she'd blend right it.. it's a common thing.

Yeah, no waiver. In fact there will already be concerns about her medical expenses in the US and the fact that she is diabetic and suffering from some of the effects of it will only heighten those concerns. Be prepared to show that you will be able to provide Medical Insurance for her so she doesn't become a public charge.

Anna is Advanced Open Water Certified and I'm Master Scuba Diver Certified. I really want to get back to the Philippines to dove some more WWII wrecks and Anna misses the fish. Here in Illinois all of the local diving is cold & dark.

We've been very busy with family things lately and our gear has gone unused for too long...

If you really think she can get better medical treatment in the US, and if you can afford to foot the bill for her treatments, then she might be able to get a B2 visa for medical treatment. You need a diagnosis letter from a physician in the Philippines, and a letter from a doctor or hospital in the US that will accept her for treatment.

CBP normally only allows a six month stay with a B2 visa, but they have the authority to grant a stay of up to one year. If her treatment is ongoing, and you can get the doctor or hospital to back that up, then she can apply for up to two extensions. She can also leave and come back later to resume treatment.

The B2 is pretty much the only provision that the law makes for someone who seeks to enter the US for medical treatment. Requiring medical care isn't a basis for any type of immigrant visa.

A permanent resident cannot petition for a parent under any circumstances. Your wife will have to wait until she's a US citizen.
