Ok everyone i have so many questions i dont know what to do with, please help in anyway you can, i will be forever greatful.

Background: Im 18 and went to the Philippines to marry a girl i met online almost a year earlier. I spent ever dime of my money on tickets, a passport, a wedding ceremony with all the trimmings, and a 2 and a half month stay in the philippines. I got married on january 12th of this year and stayed with her until March 4th when i flew back to America. Since i am only 18 i had to have tons of evidence saying i had parental consent to marry her because its a law in the philippines that you must be at least 25 b4 you can marry without parental consent. I included all that documentaiion in the I-130 packet i sent. i had her sign her G-325a forms while i was there in the philippines and filled mine out when i came back. Before coming back we found out she was pregnant but i did not say anything on the form because it never asked. She will probably give birth by the time this process is completed fully.

What ive done so far:

I filed the I-130 and the G 325a's that went with it and submited it along with all the required information.

Got NOA1 via email along with reciept notice and case number, it said it was sent to California service center for prosessing. I recieved this email on March 12th.

Now for the onslaught of questions:

1. Will me not putting down that she is currently pregnant pose a problem at a later date?

2. She currently does not have a passport but is about to apply for one, with this pose any problem if she gets her passport b4 the date of her interview or will she need to have a valid passport for some stage of the petitioning process before that time.

3.I live with my mom,dad, and brother, sooo including me and my immigrating wife that would make our household a 5 member household although my mom,dad, and brother do not rely on me for support?

4. If number 3 is correct then i do not make enough to meet the 125% of the povertyline standar for a houslehold of that size, my grandpa said he will be a joint sponsor for me. Does he have to make enough money to support himself, his wife, one of his kids, and my 5 member family?

5. My grandpa who said he would be a joint sponsor lives in texas, i live in michigan, is he still allowed to joint sponsor with me?

6. What forms is my grandpa, as a joint sponsor, required to fill out and submit along with his I-864 form?

7. Does he file his Affidavit support packet stapled to the back of mine after he completes all the information and sends it too me in michigan, or does he file it from texas, were he lives, and just include a not that pertains to my case?

8. Will the baby, if it is born in the philippeans before she can have her interview will it beconsidered another family member, and force me to start the affidavit of support process all over again???

9. When she takes her medical exam before her interview, what must she do if she is still pregnant? What must she do if she has had the kid already?

10. If the child has been born before her interview will they still let her come to america as without any trouble as long as i file a birth abroad form?

11. Does a joint sponsor need to be witnessed by a notary of public that it was indeed them who signed and completed all the forms and documentaion in the I-864 joint support packet?

12. On my grandpas I-864 form, when it asks the number of family members in his household, does he put his household only, his household + my household, or my household?

13. Should i make note of the unborn babies presence in the situation on my Affidavit of support packet? Must i provide proof that i told my joint petitioner(my grandpa) about the baby?

14. What vaccinations are needed to enter the U.S. form the Philippines? If shes pregnant still when she goes to get any vaccinations that she dosent already have, what will they do? Will they make her wait to come to America untill after the babies born and a Birth abroad form is completed?

15. What papers should my spouse prepare if the affidavit of support process is approved, also, what papers should i get ready?

You dont have a 5 member family you have a 2 member family. Your granpa only needs to support his family + the immigrant when he is a sponsor.

As a joint sponsor he only needs to fill out the I-864 , provide proof of his income and proof of US citizenship. Tax transcripts, pay stubs, letter from employer. Copy of passport or US birth certificate or naturalization certificate.

You need to send both together in the same package but do not staple them together as they are 2 separate items.

The baby will be another member but the baby will be USC and you have to file for a CRBA and US passport. You will want to research this. It will also make your house hold 3 - you,mom, baby.

She will not be given any vaccinations because shes pregnant. She will be given a "blanket waiver" and have to get the vaccinations in the USA after she enters ( after she has the baby ). IF she is 7 months pregnant she might not be allowed to fly to the USA because it could cause problems with the pregnancy causing early labor. This depends on doctors orders.

15. What papers should my spouse prepare if the affidavit of support process is approved, also, what papers should i get ready?

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Thank you soooooo much, you are a answered prayer:)!!! I have a few more questions if you dont mind:)

1. Im not insulting you, i owe you so much, im just super paranoid and maticulous(i cant spell), how sure are you about your answers?

2.For question 11, http://www.4uth.gov.ua/usa/english/travel/visa/checklis.htm says i should have a notary of public witness it? IM confused, do i or not?

3.Do i request a blanket waiver? Or will they be like," it seems she is pregnant, we will issue you a blanket waiver".

4. What if she has had the baby by then, will they make my grandpa submit another affidavit of support or have us redo that process if the baby is born b4 the interview?

5.So i can just hae my grandpa fed ex or usps his I-864 packet to me so i can put it with mine?

Your granpa wont be sponsoring a US citizen. They do not need to be sponsored to come to the USA, just need their US passport. - Only you would need to add the child to a new 864 form because it makes your house hold 3 people instead of just you and her.

So i would have to get another i-864 form, and submit another packet along with another joint support packet from my grandpa? I understand that the baby would be a US citizen but im not understanding what the NVC is going to make me do if they find out a baby has been born after the I-864 form is filed......?????......

2. what if she has the baby after my NOA2, but b4 i can send my packet, when i include the baby on the I-864 form, arent they going to wonder why i didnt mention this child on the I-130?

5. So hes only showing proof that he can financially support my spouse and his family?

6. So even if i had 100 people in my family that were dependant on me including myself,and my household was 111, as long as i was only petitioning for one person(that being my spose) he would only have to have enough money to support her???

YOU, as the father of the child, will add the child to YOUR household count. Because the child is a USC, your grandfather does not add him/her to HIS household count. Your grandpa only has HIS household plus any immigrants. The child isn't an immigrant.

Then you add the child anywhere it says "children" or whatever. Remember the child isn't being sponsored because you will be applying for CRBA for the child to get its US passport

No. It's presently a bunch of cells. Eventually it becomes a foetus and then once born it's a baby. It doesn't count until it's born. She can of course mention it in her interview and SHOULD in her medical but it's not an issue.

No matter whether the child is or isn't born by the time you file the sponsorship paperwork, the child doesn't count in his household count, only yours

If she had other children (who weren't yours) who were immigrating with her they would count as well. Only immigrants counts from YOUR household count, the rest is just his household count

I love this site! I love you, i love inky, i love my wife, i love God, i love everything! I posted a couple of hours ago after days of research as a last resort, thinking it was a lost cause and when it came time to process the paperwork id be taking the biggest shot in the dark of my life! But within 2 hours, every question i was worried about has beeen answered:) thank you both sooo much!

Will my wife have to wait even after shes had her interview and been approved to come to america, if shes had the child already? I would think they would let a lil baby come with the mom. But i could also see them saying, hold on, you have to wait till the birth abraod form and the babies passport is approved b4 your wife can come to the U.S. with the child. And whats the bio pade of the babies passport going to look like? Are they gonna take a picture of a baby? passports are valid for ten years, what about 9 years from now when i take my kid to see his relatives in the philippines, when he hands baggae check in his passport and the guy opens it up to see a babies photo lol??? Is that really what happens?

After the birth of your child, you and your wife need to take the necessary steps to secure a CRBA and passport so any travel delay is kept to a minimum. Yes pics of the baby and both parents are required. Read this and this.

As far as taking the baby to see the relatives in 9 years from now, you have enough to be concerned with now in this process -- You can worry about 9 years from now, well, 9 years from now.

Sorry, having a child does not entitle her to move to the US without authorization. This authorization comes in the form of her visa. So no, she has to not only wait until her interview, but until she has her visa in her passport. And the child may come to the US when he/she has the passport.

Yes, they take a picture of the baby. An infant passport obviously not valid for 10 years, it is much shorter. 3 in Canada, not sure here.

I read on the US Embassy Manila website that you have to have a paternity DNA test before the Embassy will grant the baby US Citizenship , anyone know about this? They said the parents and baby go to St Lukes, have the samples taken, then mail the kit to the US for analysis before they give anything.

Actually DNA testing is voluntary, "The testing option is normally offered to applicants who have tried, but have been unable, to meet the legal requirement of establishing a biological relationship (filiation) on which nationality may be based."

DNA test may be requested, but since you were married and can cleartly establish you were in the same place when conception took place, it is unlikely.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
