On question 21 - your household size

Me and my husband live with his parents and sister, he is studying, he doesnt have any dependents, and only his mom is gonna submit form I-864A

5 people live in this house, but he doesnt have any dependents, his sister and his dad arent his dependents

so on line h) Add together lines and enter the number here. Household size equals 3 but on his mom-s I-864A is going to show 5 because her husband and daughter are also her dependent's but not my husband's.

Can it be different in each ones form? If not, What do I do?

What line do his father and sister belong to? are they considered his dependents even though he studies and its his mom supporting everyone?

Is this correct? Household size is the number of people living in the same house even if not all are dependents or am I mistaken? please help

According to 8 CFR 213a.1(Title 8 -- Aliens and Nationality; Chapter I - Department Of Homeland Security (Immigration And Naturalization); Subchapter B- Immigration Regulations; Part 213a- Affidavits Of Support On Behalf Of Immigrants),household size means “the number obtained by adding the number of persons specified in this definition. In calculating household size, no individual shall be counted more than once. If the intending immigrant's spouse or child is a citizen or already holds the status of an alien lawfully admitted for permanent residence, then the sponsor should not include that spouse or child in determining the total household size, unless the intending immigrant's spouse or child is a dependent of the sponsor.”

So in your case it will be 2 for your I-864. And for your mother-in-law it is depends on how old is the sister if over 21 do not include her, so it will be 2 if less and not married, then 3.

Thank you, the sister is 13 and my mother-in-law is married, also my husband was considered dependent in her last tax return, so her household size will be 5 right? She, daughter,son,husband and me? Btw she fills I-864 too right?
