6. What is the reason for your residence: I'm here on a spousal open work permit (my husband works as a postdoc at a university here)

7. Did you list your overseas address on I130? Yes

10. Did you mention that you reside abroad in your cover letter? I didn't send a cover letter.

11. Has your case been auto expedited? How long between NOA1 and NOA2? No. received NOA1 in January, and NOA2 in May.

12. Which Service Centre? Vermont

We've used our home address abroad. Hope that helps!

Hi all,

I'm still getting a handle on all of these abbreviations and processes but I was wondering if anyone can help me? Regarding immigration for a spouse to the US, if we marry outside the country, does she need a 'sponsor' here in the US while her CR-1 is being processed? If so, will I have to stay in the US and she in her own respective country for that period of time?

Any way we can be together throughout the process.

No, she does not need a sponsor in the US while while processing her CR-1. That will come when your case gets to the NVC, which takes about 5 months. You can live with her abroad as many and I have done during the process, you will have to prove domicile though. If you have read through this thread, you will see that the majority of people who filed from abroad had their case "auto-expedited". It has been 10 days since I submitted my I-130 but I am petitioning from Canada so I don't think my case will be "auto-expedited". If you are in a hurry to be with your wife in the US, then use your address from abroad.

You can live with her abroad as many and I have done during the process, you will have to prove domicile though. So her needing a sponsor then, does not require me to stay in the US? What does it require though, would possibly my parents serve as sponsor(s) then?

Regarding proving domicile, when/how will they ask for the proof of such? My girlfriend lives in Brasil, so it might be a home visit from the policia federal?

I'm still new to the process but really trying to gather as much info as possible. Can you or someone else give me a kind of overview of the process for the CR-1 and the auto-expediting?

I'll be filing the I-130 sometime in January/February of 2013 at the US embassy in Brasil. From there though, I've heard it goes numerous routes. Help please?

I am the sponsor despite living abroad with her and will continue to do so. I am however proving intent around domicile. This includes a us bank account, us drivers license, moving quote, us rental agreement etc etc

If that's not possible (that much proof) you may still be able to stay abroad and have a co-sponsor

hi all!! have been following this thread closely as we are about to file our cr1 petition from abroad (got legally married yesterday!!). from what i've read on here, the important thing is what address you put down, and the fact that you state in your cover letter etc that you live abroad together, and can prove that with other evidence.

i'm wondering: does it matter where we send our petition from? in two weeks, we're going on a trip to NYC together. i was thinking about filing from there so as to speed up the mail side of things a bit, since that's about when we'll have all the documents ready anyway.

thoughts on this? will it matter that i'm mailing from in the country, if i put down our joint address here in chile?

also, probably this doesn't matter, but is it somewhat sketchy to enter the US with all those documents? it crossed my mind, but they'd just be in my carryon next to other journals and books and whatnot so it seems it wouldn't make a difference. thought i'd just check with yall and see anyways.

Hi, just a quick question

My fiancée is US citizen and french citizen as well. We have met and lived the past 2 years in Canada. We are returning to France to get married and plan to fill a CR1 petition and ship it to the chicago lockbox using our french adress.

Will it be a problem if we have been leaving in Canada for the past 2 years and not in France ?

I never mentioned it in my cover letter (many others in this thread havent either). Seems only the address in your forms makes a difference. Where you mail from doesn't matter so do what works best. If I DHL from Ireland, it arrives the next day but I realize not all countries have reliable services so that is up to you.

For the I-130, I actually sent it to my parents in NY who put the US Dollar check in for me and they sent it to the Chicago Lockbox....I was still expedited.
