assuming your wife is the USC, yes then she is the one that will be filing on your behalf so she needs all documents to send in with the packet

Who is the petioner? You or wife? If you are the petioner, provide documention that shows your are a USC, example: birth certificate, US passport, a copy of proof of naturalization etc.

a copy is what i sent, u will need the original at the nvc stage.

I think you should really take some time to review the information that mayarz posted for you, as well as the I-130 instructions...It can be tedious but the answers really are there. Are you the US citizen or is your spouse?

If you read the VJ guide and the USCIS instructions carefully, you will see that YES, you need to send the birth certificate of the US citizen if that is how they acquired citizenship in the US (i.e. - born on US soil). If they were naturalized or gained citizenship through some other way, then review the other ways to show that you are a u.s. citizen. The birth certificate or other documentation of citizenship goes in the packet with the appliaction I-130 and g-325a (and everything else on the VJ list) to the lockbox.

Loveturtle - I think Divs was referring to evidence of a bonafide marriage (needed with the I-130) and you are referring to evidence for the affidavit of support I-864 which comes later.

Hello, I am Simo's mother in-law, I am going to be the one sponsoring him to come to the USA to live with us. They were married in morocco and will reside in the USA. My concern is that she is still in morocco, and I would like to start filing for his papers now, but i want to make sure this does not hurt my daughter coming back to the states since her name on her plane ticket and passport and such is not the same as her married name now. I have the I-130 downloaded and filled out, except my daughter's signature. I do not want to make any mistakes in this legal matter to make it any harder or longer for him to come here. I would do all the work myself but it does not have mother in-law as an option to file.

Hi Mom. Some Notes for you.

1. travel documents are golden (passport and air tickets) . She's not changed her name, legally, yet.

2. have HER fill out the I-130, two G-325As, submit additional documents, following the VJ Guide at http://www.visajourney.com/content/i130guide1

3. you cannot sign for her unless you have an unlimited power of attorney document in place, and can provide copy with the I-130 submittal.

4. RE: you doing 'work' - sorry, it's on the petitioner to make this happen, yer daughter. Either she trains you, or you train her, in the end she signs the document. YOU CAN EMAIL HER the 'saved I-130 pdf file) and she can sign it, and postal mail / DHL it back to you, with the rest of the supporting documents that she needs.

5. I assume she's not handling this because she's unable to give a check in USA funds on a USA bank for 420, at the moment, yes?
