First of all let me apologise for posting again and you are probably answer these a thousand times. Well my husband and i we have decided to file the I-130. I've posted here before asking questions and now that time finally come i am nervous. He had just got his PR in canada and is able to travel, we while he was here in the US we got marry so i am trying to get ready to send the forms but will canada block him? Since he just got throught that process with them for canada PR? My next question is for the evidence we don't have much, like i see some people here do. He came see me we got marry and took some picture within that week. We have cards that we send to each other, talk on the phone a lot. Is that enough? The fact that he is residence in canada will that be a problem? We are from haiti. Will that cause a dwaft on the process?

Sorry if i sound like a broken record and confuse. I am just nervous and don't know where to start and what to expect.

Canada wont "block" him from doing the Visa rout to go to the USA to live with you. You will need to do some research ( or maybe someone here knows ) in case his PR status can run out or "expire" because he is not living in Canada as a PR like he is supposed to be doing.

Spousal interviews are only conducted in Montreal Canada.

Immigration medicals are conducted in Vancouver, Toronto and Montreal.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

I am confuse about this part. Can you explain please?

Being a permanent resident comes with rules such as living in the country that you got it from. Not being outside of the country for a certain amount of time etc.

A basic google search shows this http://www.cic.gc.ca/english/newcomers/about-pr.asp

Keeping your permanent resident status

Your permanent resident status allows you to live in Canada, but there is also a time limit on how long you can live outside the country. To keep your status as a permanent resident, you must live in Canada for at least two years within a five-year period.

Losing your permanent resident status

There are several ways you could lose your permanent resident status:

  • A permanent resident who does not meet their residency obligations could lose permanent resident status.
  • If convicted of a serious crime, a permanent resident may be deported from Canada.

Minimum residency obligations

http://www.cic.gc.ca/english/information/applications/guides/5445ETOC.asp#appendixAYou must meet the residency obligation to obtain a Permanent Resident Card. The following table represents the minimum requirements.

  • If you have been a permanent resident for Five (5) years or more
    • you must have been physically present in Canada for a minimum of 730 days within the past five (5) years.

[*]If you have been a permanent resident for less than five (5) years

    • you must show that you will be able to meet the minimum of 730 days physical presence in Canada at the five (5)-year mark.

Basically,

If he does not maintain status as a Canadian resident he will lose his PR status. You need to research this more and find out if he wants to abandon status to move and live in the USA.

We were planning of going back after this was over. But if he have to be there 730 without traveling then that imposible. Bcause in the usa GC you can be out for 6 months. Is canada like that at all?

How long ur spouse is living in Canada?

No i never went to states. My bad luck was after marriage i applied for visit visa but they said apply for CR-1 visa not visit visa.(you are married to a usa citizen you might not come back  )After that we applied for I-130.Never tried to stand for any visit visa.As far as i know(immigration Person told me)YOUr Pr card has 5 years to expire.you Can visit to anywhere but have to be in canada 1095(3 years) days between 5 Years.I went to me country several times.I Count the Years and 3 years is done.So i gonna aply for Citizenship soon.

If you like to maitain ur spouse's Pr just stay in usa 6 months. Then come back to canada.Stay here 1/2 Months then go back to States. So that both way you can keep balance.

No worries you can ask as many questions you want.i annoy poeple too if i have questions. It took me 6 month to get approved.I request for expediate after 6 month.Usually the uscis timee frame says that 5 months but most to the cases it takes longer. Some people get early approval though. The slowest service center is California Service center.I wish i sent my I130 from Newyork than it would have been approved early.(vermount Service center)is usually eary than california. where you live in States?
