Hello;

Just want to say thanks to everyone! Me and my wife are doing great and everything is fine,

However her friend who came to the United States a few months before her is not doing so well. She came her on a K-1 Visa got married and filed for AOS Got her Social security card and Bio metrics done but no interview yet after learning that things would not work out with her new Husband she was heart broken and tryed to make things work out for them after that did not work she left and went back to her Country, she has sent hm email and tryed to talk to him but he does not respond should she just send him a registered letter asking for a Divorce or and also send a copy to Homeland Security? She was married in California and I dont know what there laws or etc. are there

Thanks for any suggestions I might let her know about

Validity of Foreign Divorce in US

Generally, a divorce granted by a court in a foreign country is recognized as valid by US courts through comity. Comity is where the courts of one country respect and enforce another country's laws and judicial decisions. In most states, the courts will enforce a foreign divorce only if both spouses received adequate notice of the divorce proceeding, meaning:

  • One spouse was living in the foreign country at the time of divorce, and
  • The spouse living in the US received service of process - the formal delivery of legal notice of the divorce proceeding
