Timeline

Yesterday, I received a letter from USCIS requesting proof that my husband is eligible for his IR-1, not CR-1. His status at POE was CR-1, but should of been IR-1 because we have been married over two years prior to his POE. We were treated awful when calling USCIS customer service to inquire about having this correctly. The representative went as far to say that he was given a CR-1 status because they(Casa) did not completely feel that we had a true relationship and then hung up on me. I am just shocked that she had the nerve to misquote the law. Now what to do?

:blink: wow, I have no advice, but am so sorry this is happening. #######?? The consulate/USCIS can circumvent the law just because they don't believe the relationship still, and now you have to essentially adjust status?? Is that even legal?!?

This is terrible!!

I would get your congressman involved. Make sure you get the ID of the person you are speaking to so that you can track down the incompetence in the future :(

I finally emailed my Senator who stated that they will try to find out who spoke to me that way. My senator's office did apologize, but I am thinking that this will continue with others.

Timeline

I usually get operator names and numbers (they never give you their last name but are required by law to disclose first name and operator number). If that was the response, do an official request in writing to USCIS request that they issue the IR-1 in accordance to the regulation, policy, act etc... that governs it. Include a copy of said regulation, they are required to respond in writing and either deny or issue the IR-1 or explain the reason for failing to follow standard operating procedures.

Please remember that the personnel that answer the phones at USCIS are not immigration officers, you got your Senator involved so you can choose to wait at this point or move forward with a request. Ensure you send it express or certified mail to ensure you can track who and when the document is signed for an received.

Thank you for your advise. My senator filed a complaint on my behalf as we have had many other issues in this process. I know that my Senator forwarded the required documents. Now we wait and see which is what we all do.
