Good morning Vj's, my brother is married to a USC and his wife filled a petition for his daughter who will be 15

in August, my sister in law will have her interview on the 19th of March for that I-130 petition. My concern is what will

be the implications if the petitioner is currently unemployed?

They will need a cosponsor.

Your post is confusing though. I've never heard of interviewing the US Citizen Petitioner for an I-130 petition.

They have sent me the copy of the correspondence form USCIS that she needs to be there for an interview, just don't know why.

Just to be 100% clear, the US Citizen Step-mom will have an interview at the local USCIS office before the I-130 can be approved?

This isn't the Consulate Appointment in Manila?

Are you sure they only filed an I-130 and not something else?

Maybe if you post the actual content of the appointment letter (omitting personal data) that might shed some light on the request.

What Visa did your brother enter the US on? Where in the process is he? (for example K-1 Entrant not yet AOSed or AOS is processing, etc).

he came in a tourist visa, stayed undocumented for sometime before he met and married his wife right now he is waiting for his green card, glad that

you had replied to my query in that way i will be able to understand the kind of process where he is at.

what documentation did she send with the i130? it's unusally for an i130 interview for stepchildren, usually it's for the spouse when there isn't enoough proof of bonafide marriage. maybe they need more information, or they want some type of proof, in order to approve the i130.

Since he AOSed from a Tourist Visa overstay I would recommend you confirm exactly what they sent in for the child.

See if you can post a copy of the exact letter (redacting personal information)...
