Hi All,

This is my first posting and was looking for some information and advice,I have been seeing a woman from Kazakhstan and now would like

to have her visit me here in US this September on a tourist or visitor visa,the main reason for her to come here is for us to spend together

but also she has been invited to my nephews wedding...can this be done and if so which way should we approach this?

My concern is the best reason given for her visit to my country, I want to be honest.

Your biggest concern as well as hers should not be the reason for her visit. It must be the reasons she must return to her country. This is where the case will be decided.

She will need to understand & comply with the strongest ties rule while keeping in mind all people with any type of visa are considered intending immigrants. She must prove beyond a doubt that she must return rather than attempt to immigrate.

How she will succeed at this will depend on many factors. Her age, her job, her exact situation that compels her to return. If this cant be done correctly she wont need to worry about a reason to visit.

Her reason for the visit should be thought thru as well. Of course be honest but temper that with some thought to how it sounds to others. Your statement says we want to spend together while attending a wedding. Sounds like a shopping trip to buy wedding gifts possibly. We all know what you meant but when she is asked how would it sound? In other words exactly what will she put down & be able to explain correctly. You wont be there so she needs to be totaly prepared because its over very quickly with no second chance.

First, how old is she? Second, what types of real property does she have? Third, what are her ties to returning to Kazakhstan? Forth, will she interview in Almaty or Astana? Fifth, how's her English?

My now wife applied in 2008 for a tourist visa. She was almost 40 years old, single (of course), had an apartment, family and a very well paying job by Almaty standards. She was denied when she interviewed in Almaty. She was interviewed by a young woman. My friends who also wanted her to visit contacted their congressman and she re-applied paying another nonrefundable fee. This time she was interviewed by an older man and he did not ask many questions and told her to have a nice trip. She also was able to get another tourist visa in 2009. For her K-1 interview she had an older woman. She was approved. Not sure if contacting the congressman had any influence, but I know the change in IO did. My friend had several people go thru the US Consulate in Almaty as he worked at KIMEP and the older man was someone he knew and said he was a nice guy. I hope he is doing the tourists visas as we want to try to bring my wife's Mother this summer for a visit.

She will need to explain the reason for the visit and who is paying for her stay in the USA unless she has a very large amount of cash in the bank. Your nephew can write her an invitation letter which may help explain why she is visitng and also put who will fund her trip. I know most people say that inviation letters are not needed, but my friends wrote the letters for when my wife was approved and I wrote the first invitation letter--that was the only difference in the evidence she took to the Consulate.

I think this works in her favor that she will leave her 4 yr old son in the care of her mother at her apartment while on travel and that she is 34 yrs old,plus my nephew will send a real invitation to the wedding and I would provide proof that I assume all the funding of her stay and clear proof of her return to Kazakhstan...so what do you think? can this work?

Also I visited her 3 weeks ago and will return to see her in May,does this history of me going to visit with her carry any weight with her getting the visa?

These are the thoughts I have...

1. She could provide a letter from her employer stating how long she has worked at this business and when they expect her back from vacation.

2. She has a 4 year old son who will be waiting for her return in the care of her mother.

3. She has a apartment she has lived in for 11 years.

4. A clear invitation to a wedding.

5. I will show proof that I will assume all financial responsibility.

6. We are being honest.

7. She has a life long friend from Kazakhstan who is married and living in the US that she wants to visit with.

So will this work?

All depends on the IO. Make certain she has documents about the son and about the son's father, documents about work and their expectations of her return, and documentation about her apartment--all should be translated from Russian to English. The Mother of a friend of my wife's was able to get a tourist visa. It is possible. Just show the ties to Kazakhstan and do not offer informaton about the friend living in the US as that is not important for her to return to Kazakhstan. I would also suggest that you do not offer information about your relationship, but if asked do not lie about it. I would see if you could have the nephew invite her and pay for her trip. Her son, job, apartment, and mother are good reasons to return--use them.

Your visits are only good for a K-1 visa. They have no bearing on her tourist visa. And can be used to show that she wants to use a tourist visa to visit you and remain in the US. The important fact about a tourist visa is that the applicant must over come the assumption that they will immigrate to the US. From what I have seen it is very IO specific especially at the Consulate in Almaty.

So I would have her get all the documentation together about the son, her job, her relatives in Kazakhstan, an invitation letter from your nephew plus the wedding invitation, and her property. Pay the visa fee and schedule an appointment and see what happens.

I could see that could be an issue.
