Well, my wife is in her home country since we got into an argument while on vacation so i left her and came back to the US. Her green card expires in 6 days and i have her green card and passport on my bag, which we both forgot about. Anyway, i am not a jerk and want to help her out regardless if we fix our relationship or not since She is the mother of my son.

since i would be filing to remove conditions this late, 6 days before expiration, how would she be able to get back into the country? I don't think the passport and green card will get back in time or if i can secure a flight ticket. Just need help on worst case scenario. Would they provide something for her to return while the conditions are removed? how would this work if she is not inside the country when the GC expires, and we are just removing conditions less than a week before the conditional GC expires?

Well first of all, let this be a lesson that you should always be on top of your ROC application. Although you only have to do it once but make sure you do it right.

I suggest you file your ROC RIGHT AWAY. Now depends on the situation and how fast USCIS responses with a NOA letter which will be act as an extension of your soon-to-be-expired conditional GC, you can use that NOA letter (original if possible) and the GC to re-enter the country.

Any other thoughts? This is as far as I can think off.

Only use the Original letter. Many people are stopped because of having a copy and not the original.

i am not a expert but i am sure that someone on vj could give you better advice than me. you can send passport and gc by fedx, overnight and it will get there 3 days the most but you have to do this now. without passport and gc, your wife is stuck in her country. like i have said before, i am sure that someone on vj can give you more information than me.

Just file the paper work and overnight the passport and gc. But why would you pay to change your ticket after a fight? Wouldn't it make far more sense to go get a hotel or even hostel for a week or whatever you had left and cool down than leave your wife in another country (even her own)?

Yeah, but it is not that simple. I found out she was planning on meetng with an ex through facebook when i read some messages on her laptop. She was flirting and calling him "my love" ect.. So i didn't want to be anywhere near her at that moment and didn't really care about her GC at that point either.

I guess I'll just wait for the NOA1 one and mail that to her with the passport and exprired GC. Do you guys think they would reject my case or not send me the NOA if I send in the packet one or two weeks late?? I ask this because with work and school i don't know if i will be able to get all the documents ready on time, and I don't want to send in something incomplete. What do you guys think?

That is why i am asking is it would make a huge impact if I sent the form one to two weeks late after the conditional GC expires. I'll will have to email her a copy of the filled form so she can sign it, and then she would have to mail it back. Has anyone here submited the form or know anyone that submitted the form late? form will be late one to two weeks i think. Anyone had a good outcome from digging out of this hole?

You will have to include a letter explaining why you filed late. Its going to need to be a good one because you can file 90 days prior to the expiration date on the card. It is at their discretion to accept it and process the petition or not and deny the ROC.

You fill out the I-551 form and overnight it to her.

She signs, and overnights it back to you.

You overnight it to the USCIS.

Should be doable in 6 days.

You are not allowed to mail a Green Card, but sometimes we all have to do what we have to do. Once you have received the NOA1 in the mail, you'll overnight it to her together with the Green Card and her passport.

That's the only way, short of sending a courier or flying there yourself.

ok - so you just grabbed your stuff, and your wife's passport and greencard, went to the airport, changed your ticket - and flew back to the US without your wife after an argument over some ex of hers on FB, right?

You seem to be a spontaneus person - which will work to your advantage right now:

Just grab your stuff again - don't forget your wife's passport and greencard (and also take that I-551) - go to the airport, buy a ticket for yourself on the next flight that takes you close enough to whereever you left your wife and fly back to her. I don't know what date her flight back home to the US is scheduled to be - I strongly advise that you fly back home together! Sou may have to reschedule her flight home.

You can be there tomorrow! Also, before you leave, schedule an infopass appointment for the next possible date at your local USCIS field office in the US. Friday March 16th would be best.

Fill that I-551 out together, both sign it! Then you fly back to the US the very next day together, which would be Thursday, March 15th.

On Friday both of you go to that infopass appointment and file you wife's I-551.

Yep, if FedEx, DHL or UPS can guarantee overnight to and from Belize - this sounds like the best option.

If not, fly to Belize tomorrow, and fly her back with you.

If she's the mother of your children, and you think you have a future together, I absolutely would not chance sendin it in late.
