Hey Everyone! This question is more directed at people who are living in Texas...

I had a Texas drivers license a couple years ago when I lived here with my parents on a H4 visa. We then moved to Canada and this is the drivers license I have now. I am now back in Texas and my husband and I got married feb 14th but I cannot apply for AOS until after our son is born in April.

My question is, can I get my Texas drivers license back even if I am "out of status" as they say?? and if I can, can I even drive??

Canadian drivers licenses holders can drive in the US for like 30/90 days depending on the state. They also have an agreement with the Canadian gov about the drivers license and some states don't even require you to retest or only have you do 1 of the tests and change ur license over directly.

No to getting your TX license back. You will have to prove lawful status. My husband had to prove lawful status again and in person just to change his address. Chart: http://www.txdps.state.tx.us/DriverLicense/documents/ImmigrationStatusChart.pdf

K1 is on page 16. Your I-94 will get you a license that expires when the I-94 does, which for you is about next week.

You can drive for 12 months as a visitor on a foreign license. At this point I see you as a visitor because you have no greencard. If you get stopped by a cop, don't expect him to understand immigration or why you failed to get a TX license within 90 days of residing in the state.**see note. That's why I would not say "I live here". With your expired I-94, you don't even have a document to show you're still in status as a visitor.

**note on cops: Happened to my husband and it took a long time to convince the Highway Patrol trooper he couldn't get a license yet. We basically talked our way out of extra citations. That's why I think the better answer would be "I'm currently visiting, but will be applying for a greencard so I can live here with my husband permanently."

From what we experienced you won't be able to get your Texas DL back until you adjust your status. But as stated here Texas DPS-DMV Moving Questions New residents moving into Texas, who are at least 16 years or older and have a valid driver license from another state, have 90 days after entry into the state to secure a Texas Driver License. All out-of-state applicants must visit a Texas Driver License office to present and complete the following:

If you have a valid out-of-state U.S. driver license or a valid driver license from Canada, France, or Germany, please bring it to the driver license office to surrender. The written and driving examinations will be waived, but you must still pass a vision exam.
