The Derivative REQUIRES the TRANSMISSION REQUIREMENTS (the one I posted Earlier) -- this is the crack in citizenship for birth abroad, the transmission requirements must be met. Therefore, in the NEW(1986) law, children who weren't able to get CRBA before they turn 18 cannot claim US citizenship anymore.

Hence, the father must really talk it out to the mother before the child turns 18.

I have Amerasian friends who fell for this requirement crack. They were over 18 (but born 1988) when their father decided to pass the citizenship to them. One even consulted Atty Merrel, an immigration attorney, and he bluntly said there is no chance of getting US citizenship for his son.

I would also like to add that the Derivative Citizenship for Adults is not always well applicable to everyone even those born before November 1986. The transmission too highly depends on the state of the father...their legitimation requirements. Some have "age limit"

I am posting this not to scare people but to inform US fathers in particular not be be lax on their children's citizenship unless they want their children's birth right taken away when they reach 18. If they were US mothers, there's not much to worry but US father's should worry a lot
