I keep seeing people say that the I-134 form isn't legally binding….. does anyone have information to prove that? Sorry to change subject but trying to figure out how its not legally binding… thanks

From the Adjudicator's Field Manual: I-134s not binding

Such affidavits, although helpful in judging financial ability, are not legally binding.

Buying her a ticket home does not solve the problem...she's a person not a sweater. you can't just return her...USCIS can in due time. Sorry to hear it fell apart for you! Def protect yourself and cut her off anything she's tied to you with. Good luck! :)

How about to seek annulment, maybe you have some ground for that.Is there anything that you discovered about her after getting married like frequently use of drugs or alcohol? or if you believe she never intended to be married, the marriage was sought to deceive you for the purpose of obtain Green Card????

Don't ruin your life...File for Divorce immediately, DON'T file AOS. Don't sign anything she gives you. You can very well get divorced without her consent, all you have to do is file the proper documents and notify her accordingly. She cannot use the I-864 to force you into doing anything. Her threats only show that she did not marry you in good faith. Get her out of your life ASAP. You can very well find someone here in the States. The I-864 is a contract between you and the U.S. Government. IF YOU DO NOT PROVIDE SUFFICIENT SUPPORT TO THE PERSON WHO BECOMES A PERMANENT RESIDENT BASED ONT HE I-864 THAT YOU SIGNED, THAT PERSON MAY SUE YOU FOR THIS SUPPORT. SO ACT NOW, DON'T HESITATE.

Check my previous screen name. That woman was a complete scam (w/friends who were 'bad news' by Colombian standards). Thank GOD I didn't marry her. Do yourself a favor, and don't worry about feeling sad/lonely. You will thank yourself for having the courage to stand up to her and send her back to the UK.

Hello Everyone,

My wife and I have been married little over a month now, and every day has felt like a struggle. While going through the K1 Visa, I flew to be with her, and we argued. She convinced me that this was due to the stress of being in a long distance relationship, and that things would be better once married. I am gullible, and naive, and even though I had many doubts before we married, I loved her enough to want to fix them. Things have not only changed, but gotten worse. I will admit, I argue just as much as she does, but while I see that we were just not meant to be, she refuses to let go. When angry, she has threaten to use the affidavit of support I signed with the petition packet to extract as much money as she can. My question is, can she use this for her benefit?

Also, we have not filed the AOS yet, and at this rate, I do not want to go into this any further. What are my options now?

if she wants to scam him or put preasure on him & maybe even use blackmail

that paints her in a whole new light ....doesn't it

now having said that if it just wasn't working out then it mite be different

i would treat a lady much different if she was just really homesick than one who was trying to screw me over.

Sounds a lot like my prior marriage. I could not understand often why exactly we were arguing until I realized that she actually lived for the conflict!

Get out now! File for divorce and DO NOT consider doing the AOS and I-864! You have seen what she is capable of by her threats; fortunately, she can not yet do any of that to you at the stage you are still at in the process. And if you decide you still want to find a compatible spouse you might want to consider dating someone from Eastern Europe, specifically Russia, Ukraine, or Belarus! Yes, there are scams out there but ALL the women I met while dating were for real and saying it was a huge eye-opener is an under-statement!

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Today, I told my wife I no longer want to be with her. She's very hurt, understandbly so, and has demanded I leave the apartment I pay rent for to give her space. Seeing how it's I that want the divorce, and that she has no money for a hotel, and no friends or family here in NYC, I have agreed to go. I've offered to buy her a plane ticket back home, but she hasn't specified a date yet, saying she'll need about two weeks.

Knowing now that the I-134 is not a tool she can use against me in anger(huge thanks to everyone, especially Honey Crumpet for pointing that out) is very reassuring. It's allowed us to talk about the whole process rationally, without fear of persecution or personal gain.

PLEASE remember where we talked about VAWA and STAY AWAY from her. If she tries to claim abuse (which many immigrants in her position do out of desperation) you could be in a lot of trouble. Please protect yourself so this doesn't go bad. She doesn't need 2 weeks to leave the country... she hasn't been here long enough so she's planning something. PROTECT YOURSELF!
